The Auckland Highway Districts Validation Act, 1877.
Premble.
WHEREAS Sir George Grey, as Superintendent of the Province of Auckland, did, under and in pursuance of the powers contained in the seventh section of the Auckland Provincial Act called “The Highways Act, 1874,”
by notification in the Auckland Provincial Government Gazette, purport to divide certain portions of the said province into districts for the purposes of the said Act: And whereas it has been declared that such notifications not being in accordance with law are invalid, and it is expedient to validate the same:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Auckland Highway Districts Validation Act, 1877.”
2 Highway districts published in Auckland Gazette to be deemed duly created.
All such notices made or purporting to be made by Sir George Grey, as such Superintendent as aforesaid, shall be and be deemed to be and to have been, from the respective dates of their publication in the said Auckland Provincial Government Gazette, good and valid to all intents and purposes whatsoever; and the highway districts created, or supposed or alleged to be created thereby, shall be and be deemed to be and to have been duly created highway districts under the said “Highways Act, 1874,”
since, from, and after the said respective dates of publication.
3 Empowering clause.
It is hereby declared that the Parts numbered II., III., IV., V., VI., and VII. of “The Highway Boards Empowering Act, 1871,”
shall be and be deemed to have been on, as, and from the first day of January, one thousand eight hundred and seventy-two, proclaimed, 1 extended, and applied to any highway district in the Provincial District of Auckland purporting to be constituted by any notification as aforesaid under the authority of the said “Highways Act, 1874,”
as fully and effectually as if the Superintendent of the said province, upon the recommendation of the Provincial Council thereof, had by Proclamation duly proclaimed that such Parts should extend and apply to any district so constituted: Provided that nothing in this Act contained shall affect an action recently tried on appeal by the Supreme Court in Auckland between William Aitken, appellant, and Alexander Bremner, respondent.
