An Act to amend “The Wellington City Reserves Act, 1872.”
Preamble.
WHEREAS by “The Wellington City Reserves Act, 1872,”
hereinafter referred to as the said Act, it was enacted that the Superintendent might, with the advice and consent of his Executive Council, appropriate any part of the land described in the Second Schedule to “The Wellington City Reserves Act, 1871,”
commonly known as the Wesleyan Reserve, not exceeding twenty acres thereof for the purposes of an Orphanage and Hospital, and of the grounds to be annexed thereto, and might convey the same to Trustees for the purposes of such Orphanage and Hospital in such manner and subject to such conditions as to the said Superintendent, with the advice and consent aforesaid, should seem meet: Provided that no such appropriation or conveyance should authorize the granting of such land for the purposes of a denominational Orphanage and Hospital: And whereas the office of Superintendent of the Province of Wellington has ceased to exist, and the reserves referred to are now vested in the Crown:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Wellington City Reserves Act 1872 Amendment Act, 1877.”
2 Governor may convey to Hospital Trustees.
The Governor may convey to James Coutts Crawford, William Waring Taylor, and Henry Bunny, the Trustees of the Wellington Hospital, those portions of the reserve described in the Schedule hereto as Lots one and three, to be held by them, the Trustees, in trust for the maintenance of the Wellington Hospital.
3 Governor may convey to Benevolent Institution.
The Governor may convey to the Wellington Benevolent Institution that part of the same reserve, described as Lot two in the Schedule hereto, to be held by the said Institution in trust for the purposes of an Orphanage.
4 Lands so conveyed how to be dealt with. Proviso.
The Wellington Hospital Trustees and the Wellington Benevolent Institution may respectively manage and deal with the land so to be respectively conveyed to them in such way as they respectively may think fit, with power to lease by public auction such land for any term not exceeding forty-two years in possession, on such conditions as they respectively may think fit, excepting always that no fine or premium may be taken for any such lease, but not otherwise to alienate the same or any part thereof, and apply the rent and annual profits therefrom respectively towards the maintenance of the Wellington Hospital and of an Orphanage, or for the support of orphans: Provided always that it shall not be lawful to the Trustees of the Wellington Hospital or to the Wellington Benevolent Institution respectively, to devote such rents or annual profits or any part thereof to the maintenance of a denominational Hospital or Orphanage respectively.

Lot No. 1.—1 Acre 3 Roods 21 Perches
Bounded towards the North-east by Wesley Road, 310 links; towards the East by Wesleyan Grant, 1200 links; towards the South by other portion of Wesleyan College Reserve, being Lot No. 2, 234 links; and towards the West by a private road, 50 links wide, 1395 links, in irregular lines.
Lot No. 2.—3 Acres 1 Hood 38 Perches
Bounded towards the North by Lot No. 1 and Wesleyan Grant, 520 links; towards the East by Section No. 3, Terrace District, Town Belt, Wellington, 598 links; towards the South by Section No. 4, Terrace District, and by other portion of Wesleyan College Reserve (being Lot No. 3), 510 links; and towards the West by a private road, 50 links wide, 325 links and 745 links.
Lot No. 3.—7 Acres 19 Perches
Bounded towards the North by Lot No. 2, 386 links; towards the East by a stream, 1520 links; towards the South and South-west by Section 28, Karori District, 215 links and 500 links; and towards the West and North-west by a private road, 50 links wide, 1420 links, in irregular lines.
