An Act to authorize the Governor to purchase certain pieces of Land at Wakapuaka, in the Provincial District of Nelson, for Telegraph Purposes.
Preamble.
WHEREAS the pieces of land and hereditaments described in the Schedule hereto, with the rights and easements therein mentioned, are required for telegraph purposes: And whereas such land and the land over which such rights and easements extend is owned by Wiremu Katene te Puoho, Huria Matenga, and Hemi Matenga, husband of Huria Matenga, but the title thereto has never been ascertained by the Native Land Court, as provided by “The Native Land Act, 1873,”
or otherwise; and it is expedient to authorize the Governor to purchase such land, rights, and easements from the said Wiremu Katene te Puoho, Huria Matenga, and Hemi Matenga, and to validate the title thereto:
Be it therefore enacted by the General Assembly of New’ Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Wakapuaka Telegraph Station Site Act, 1877.”
2 Governor may agree for purchase of land in Schedule.
It shall be lawful for the Governor to agree with the said Wiremu Katene te Puoho, Huria Matenga, and Hemi Matenga, for the purchase of the land described in the Schedule hereto, with the rights and easements therein mentioned.
3 Legal and equitable estate in such land to vest in Her Majesty for telegraphic purposes.
Upon the said Wiremu Katene te Puoho, Huria Matenga, and Hemi Matenga executing a conveyance to Her Majesty of the said land, rights, and easements, the legal and equitable estate in fee-simple of and in such land and hereditaments, and the rights and other easements in the said Schedule mentioned, shall be deemed to be vested in Her Majesty, her heirs and successors, in fee-simple, for telegraphic purposes, as on and from the date of such conveyance, freed and discharged of and from all estates, interests, claims, charges, and demands whatsoever.

Section 89 (on Square 23 of the Province of Nelson). Bounded on the Northeastward by Native lands, 100 links; South-eastward by Native land abutting on high watermark of the Wakapuaka mud flat, 125 links; South-westward by Native lands, 100 links; and on the North-westward by Native lands abutting on high watermark of Blind Bay, 125 links. Area, 20 perches.
Section 90 (on Square 23 of the Province of Nelson). Bounded on the Northeastward by high watermark of the Wakapuaka mud flat, 755 links; South-eastward by Native lands, 1094 links; South-westward by Native lands, 873 links; and on the North-westward by Native lands, 1341 links. Area, 10 acres.
Rights and Easements above Referred to
Full, free, and uninterrupted right of ingress, egress, way, and passage for Her Majesty, her heirs and successors, the Electric Telegraph Commissioner, and her, his, and their servants and workmen, at all times and upon all occasions, with or without horses, carts, carriages, or other vehicles, laden or unladen, through, over, and upon that portion of the Wakapuaka Native estate immediately abutting upon the parcels of land hereinbefore described; and also full liberty, right, and privilege for Her Majesty, her heirs and successors, or the Electric Telegraph Commissioner, and all persons acting under her, his, or their express or implied authority, to enter into and upon so much and such part of the aforesaid estate as is included between two lines drawn on each side parallel to and at a distance of half a chain from the line of electric telegraph now running through and over the said estate, or any deviation of the said line that may eventually be made, and to erect, set up, and maintain thereon subterranean telegraph lines for telegraph communication, and any masts or poles for the support of the cord or wire of any telegraph line, and to make such excavations in such land as may be required for erecting, placing, maintaining, altering, or removing such mast or post, or for laying down, maintaining, altering, or removing such subterranean lines of telegraph communication.
