An Act to declare that the Mayor of the Borough of West Harbour shall hold office as if he had been elected on the last Wednesday in the month of November, One thousand eight hundred and seventy-seven.
Preamble.
WHEREAS, pursuant to the seventeenth section of “The Municipal Corporations Act, 1876”
(herein called “the said Act”
), the Governor did, by Proclamation dated the twentieth day of October, one thousand eight hundred and seventy-seven, constitute as from that date a borough under the said Act, by the name of the Borough of West Harbour: And whereas the Governor, in exercise of the powers vested in him by the twentieth section of the said Act, appointed the nineteenth day of November, one thousand eight hundred and seventy-seven for the election of Mayor of the said borough, and on that day a Mayor was duly elected: And whereas, by the fifty-first section of the said Act, it is provided that the burgesses of every borough shall, on the last Wednesday in the month of November in every year, elect a Mayor: And whereas a compliance with the last-mentioned section will necessitate that another election of Mayor of the said borough be forthwith held, and it is expedient to avoid the delay and expense which would be thereby occasioned, by declaring that the person who was duly elected Mayor of the said borough as aforesaid may continue to hold the office of Mayor as if elected on the last Wednesday in the month of November, one thousand eight hundred and seventy-seven:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act shall be called “The West Harbour Mayoralty Election Validation Act, 1877.”
2 Mayor to hold office as if elected on the last Wednesday of November, 1877.
It shall not be deemed to have been necessary to elect a Mayor of the said borough on the last Wednesday of the month of November, one thousand eight hundred and seventy-seven, and the person who was on the nineteenth day of November, one thousand eight hundred and seventy-seven, elected Mayor of the said borough, shall continue to hold such office as if he had been duly elected Mayor of the said borough on the last Wednesday of the month of November, one thousand eight hundred and seventy-seven, pursuant to the fifty-first section of the said Act.
