An Act to set at rest any doubts as to the Power of the Board of the Education District of Otago to grant a Lease of Section Two hundred and forty-seven, Hokanui District, and to provide for the Exchange of the said Section for certain other Freehold Lands.

Preamble.

Whereas by a memorandum of lease dated the twenty-fifth day of January, one thousand eight hundred and seventy-seven, all that parcel of land in the Provincial District of Otago, being Section numbered two hundred and forty-seven on the record map of the Hokanui District, and containing an area of eight hundred and ninety acres, was by the Board of the Education District of Otago duly leased to one Patrick Kinney McCaughan, described in the said memorandum of lease: And whereas doubts have been entertained as to the power of the said Board to lease the said lands: And whereas the Supreme Court of New Zealand has decided that, prior to the reserve of the said land for education purposes, the said Patrick Kinney McCaughan was entitled to purchase the said land: And whereas the said Patrick Kinney McCaughan has agreed to exchange the said land for the parcel of land described in the Schedule to this Act:

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

The Short Title of this Act shall be “The Hokanui Education Reserve Act, 1877.”

2 Lease declared valid.

The memorandum of lease recited in the preamble of this Act shall be deemed to have been and is hereby declared to be a valid lease, and the said Board of the Education District of Otago is hereby declared to have had full power to execute such a lease.

3 Transfer to be made.

The Board of the Education District of Otago, or the body corporate in whom the land described in the hereinbefore recited lease may be vested for the time being, shall transfer to the hereinbefore named Patrick Kinney McCaughan the said land, on receiving from him, or from the person in whom the land may be vested, a transfer or conveyance of the land described in the Schedule to this Act.

4 Body corporate shall lease lands.

On receiving a conveyance or a transfer from the said Patrick Kinney McCaughan of the land described in the Schedule, the body corporate in whom the land is vested shall lease the said lands to the said Patrick Kinney McCaughan, for a term not exceeding fourteen years, at the same rent, and subject to the same covenants and conditions, as are contained in the hereinbefore recited memorandum of lease.

Sections 144, 444, 145, and part of 220, Hokanui District, containing, exclusive of land required for railway, an area in the whole of 890 acres, situate in Bun 207b, Provincial District of Southland.
