An Act to vest part of Block XXIII., in the Town of Clyde, in the Clyde Athenæum and Public Library, for the purposes of the said body.
Preamble.
WHEREAS by an agreement entered into by and between the Corporation of the Borough of Clyde, in the Provincial District of Otago, and the Vincent County Council, it was mutually agreed that the parcel of land described in the Schedule to this Act should be and become the property of the Clyde Athenæum and Public Library: And whereas the said Clyde Athenæum and Public Library is incorporated under the provisions of “The Public Libraries Powers Act, 1875:”
BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Clyde (Vincent County) Athenæum and Public Library Act, 1878.”
2 Land vested in Clyde Athenaeum and Public Library.
The piece of land specified in the Schedule hereto, with the buildings thereon and all the appurtenances, shall, by virtue of this Act, be vested in the aforesaid body corporate, without any conveyance or transfer; and the District Land Registrar at Dunedin may, on application to him, and on delivery of the existing certificate of title, grant and issue a certificate of title in favour of the Clyde Athenæum and Public Library of the said parcel of land.
3 Power of Trustees to lease.
All the real and personal property belonging to the said Clyde Athenæum and Public Library, or vested in it, shall vest in the Trustees for the time being of such institution, who shall hold the same for the benefit of the said institution, with power to lease by public auction or public tender the lands of the institution, or any part thereof, or any buildings thereon respectively, and also any other lands which the institution may hereafter acquire by gift, purchase, or otherwise, for any term of years not exceeding twenty-one years, to take effect within three months from the granting of such lease, at such rents and under and subject to such powers, provisoes, covenants, and conditions as the said Trustees, together with the committee of the institution, may agree upon and determine.
Schedule
All that piece of land situated in the Town of Clyde, in the Provincial District of Otago, containing by ad measurement thirty-nine and seven-tenths poles, little more or less, being Sections numbered respectively thirty and thirty-one, and part of Section numbered twenty-nine, Block twenty-three, on the map of the said town. Bounded towards the North-west by Section numbered 32, two hundred and fifty links; towards the Northeast by a reserve, ninety-nine and four-tenths links; towards the South-east by other part of said Section numbered 29, two hundred and fifty links; and towards the Southwest by Sunderland Street, ninety-nine and four-tenths links.
