An Act to enable the Governor to sell a certain parcel of Land in the City of Wellington, part of the Mount Cook Barracks.

Preamble
WHEREAS the parcel of land described in the Schedule hereto was, with other land, heretofore set apart as a site for barracks: And whereas the said land is not required for any public purpose, and it is expedient that the same should be sold:
BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title
The Short Title of this Act shall be The Mount Cook Reserve Sale Act 1878
2 Power to Governor to sell land
It shall be lawful for the Governor from time to time, whenever he shall think fit, to sell and dispose of to the Corporation of the City of Wellington, at such price as may be fixed by a valuer appointed by the Governor, or to sell and dispose of by public auction, either together or in lots, the said parcel of land more particularly mentioned or described in the said Schedule to this Act.
3 Governor may execute Crown grants
The Governor, in the name and on behalf of Her Majesty, may make and execute, under the Public Seal of the Colony, a Crown grant or grants in the usual form to the purchaser of the said land, and such grant or grants shall be deemed to convey an estate in fee-simple free from incumbrances.
4 How proceeds of sale to be applied
The moneys to arise from such sale shall, after payment of the expenses attending the sale, be paid into the Public Account.
Schedule
All that piece or parcel of land being a portion of the Mount Cook Reserve, in the City of Wellington, containing one acre two roods thirty-seven perches (1a 2r 37p). Bounded towards the North by other part of the Mount Cook Reserve, two hundred and ninety-three (293) links; towards the East by Banks Terrace, which is here one hundred (100) links wide, five hundred and twenty-five (525) links; towards the South by Town Acre numbered seven hundred and fifteen (715), three hundred and ninety-two (392) links; and towards the West by other part of the Mount Cook Reserve, one hundred and eighty-seven (187) links, one hundred and thirty-three (133) links, two hundred and fourteen (214) links, and by a road fifty (50) links wide, thirty-six (36) links.
