An Act to vest certain Lands in the Municipal Corporation of the Town of Invercargill as an Endowment for the New River Harbour, and to empower the said Corporation to borrow Money for the Improvement of the said Harbour.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The New River Harbour Endowment and Borrowing Act, 1878.”
2 Interpretation.
In the construction of this Act the following expression shall have the meaning hereby assigned to it, that is to say,—
“The Corporation” means the Municipal Corporation of the Town of Invercargill, acting under the provisions of “The Harbours Act, 1878.”
3 Land in Schedule set apart as an endowment for the Corporation.
The lands of the Crown in the Provincial District of Otago, described in the Schedule hereto, are hereby set aside as an endowment for the Corporation for the use and benefit of the Port of New River.
BORROWING POWERS.
4 Power to borrow £5,000 for purposes of harbour works.
For the purpose of carrying out and constructing harbour works in the Port of New River, the Corporation may borrow and raise any sum or sums of money not exceeding five thousand pounds.
Schedule
All that strip or belt of land in the Southland Division of the Provincial District of Otago, comprising the foreshore and margin of the Waihopai and New River Estuaries, extending on the eastern and southern margins of these estuaries from the mouth of the Waihopai Creek to Steep Head, and bounded as follows, namely: Commencing at the mouth of the Waihopai Creek, thence along the western side of road line opposite Sections 30, 29, 28, and 27, Block I., Invercargill Hundred, to the Town of Invercargill; thence southerly along the western boundary of said town, and thereafter southerly along the western boundaries of Sections 1 to 9 inclusive, Block III., Invercargill Hundred; thereafter south-easterly along the western boundaries of Sections 1 to 16 inclusive, Block XIX., of said hundred, and along the south-western boundaries of Sections 1, 2, 3, and 4, Block VI., Campbelltown Hundred, to the Waimatua Creek; thence along the western side of road line opposite Sections 9, 10, 11, and 12 of same block; thence south-westerly along the north-western boundaries of Sections 25 and 24 of same block to the Waipaka Creek; thence along the northern side of road line north of Sections 21 and 22 of said block to Block V. of said hundred; thence south-westerly along the north-western boundaries of reserve, and of Sections 52, 51, 50, and 49, to Township of Stanley; thence westerly along the northern boundary of said town, and across the mouth of the Mokomoko Inlet, to Block VII, Campbelltown Hundred; thence westerly and thereafter south-westerly along the northern and western boundaries of Pilot Station Reserve to Steep Head; thence by a straight line to low-water mark; thence northeasterly and thereafter northerly along the low-water-mark line of said estuaries to the mouth of the Waihopai Creek, being the starting point.
Also all that strip or belt of land comprising the western foreshore and margin of said estuaries, extending from the mouth of the Waihopai Creek to the most southerly point of New River Hundred, and bounded as follows, namely: Commencing at the mouth of the Waihopai Creek, near the eastern angle of Section 117, Block XV., Invercargill Hundred; thence by a straight line to the south-western angle of Section 34 of said block; thence by a straight line to Trigonometrical Station GG in said hundred; thence along the eastern boundary of Section 21, and along the eastern side of road line opposite Section 15, Block XV., of said hundred; thence southerly and thereafter south-easterly along the eastern side of road line opposite Sections 1 to 9 inclusive, Block XXI., of said hundred, to Block XX. of said hundred; thence southeasterly and thereafter south-westerly along the eastern side of road line opposite Sections 1 to 19 inclusive of said Block XX.; thence westerly along the southern side of road line opposite Sections 20 to 29 inclusive of said block to the south-western angle of Section 29 aforesaid; thence by a due south line across the mouth of the Oreti River to the peninsula formed by said river and the ocean; thence southerly and thereafter south-westerly along the high-water-mark line to the most southerly point of the New River Hundred; thence by a straight line to the line of low-water mark; thence north-easterly and thereafter northerly along the low-water-mark line of said estuaries to the mouth of the Waihopai Creek, being the starting point. The above-described areas being exclusive of all existing rights and privileges held by the Government and the public, and subject to the construction of such road lines, tramways, railways, jetties, piers, docks, and works of a similar kind which the Government may at any time sanction or construct.
