An Act to amend “The Public Health Act, 1876.”
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Public Health Act 1876 Amendment Act, 1880.”
2 Powers of Local Board of Health delegated to City or Borough Council or Road Board.
Notwithstanding anything contained in “The Public Health Act, 1876,”
or any Act amending the same, the Christchurch Drainage Board, constituted by “The Christchurch District Drainage Act, 1875,”
may, by resolution passed by a majority of the members of the said Board, delegate all or any of the powers conferred upon such Board as the Local Board of Health for the district constituted by the second section of “The Christchurch District Drainage Act, 1875,”
to any City or Borough Council or Road Board, and such delegation may from time to time revoke.
3 Who shall thereupon perform all duties thereof.
Upon every such delegation the said City or Borough Council or Road Board shall have, exercise, and perform, within the limits of its jurisdiction, all or any of the powers, rights, and duties given by “The Public Health Act, 1876,”
and any Acts amending the same, and which may have been delegated to such body or bodies as aforesaid: and no other Local Board of Health shall have, exercise, or perform any powers, rights, and duties which shall or may obstruct or interfere with the powers, rights, or duties so delegated and exercisable by the said bodies upon such delegation and during the continuance thereof.
4 Signed copy of resolution deemed to be sufficient evidence of delegation.
A copy of such resolution, as mentioned in the preceding section, under the common seal of the Christchurch Drainage Board, signed by the Chairman for the time being of such Board, shall be conclusive evidence in all Courts of law of the due passing of such resolution and of such delegation.
