An Act to appropriate a certain Portion of the Town Belt of Port Chalmers to and for the Purposes of a Public Cemetery.
Preamble.
WHEREAS by a certain Crown grant bearing date on or about the twenty-fifth day of November, one thousand eight hundred and sixty-nine, certain lands adjoining the Town of Port Chalmers, in the Provincial District of Otago, and called or known as the Town Belt of Port Chalmers, and therein particularly described, were granted to the Superintendent of the Province of Otago and his successors, in fee-simple, in trust for the purposes of public recreation for the Town of Port Chalmers and its inhabitants: And whereas, under and by virtue of “The Abolition of Provinces Act, 1875,”
the said town belt was and is vested in Her Majesty the Queen for the purposes aforesaid: And whereas it is expedient to appropriate and set apart for the purposes of a public cemetery the portion of the said Town Belt of Port Chalmers which is described in the Schedule to this Act:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Port Chalmers Cemetery Act, 1881.”
2 Particulars as to what land is included in this Act.
All that part of the said town belt which is described in the said Schedule hereto is hereby appropriated and set apart, and shall be henceforth exclusively used, for the purpose of a public cemetery for the interment of the dead.
3 Provisions of “The Cemeteries Management Act, 1877,”
incorporated.
“The Cemeteries Management Act, 1877,”
excepting sections four and five, shall be incorporated with and form part of this Act: Provided that the Mayor and Councillors for the time being of the Town of Port Chalmers shall be the Trustees to provide for the maintenance and care of the said cemetery, and shall have all the powers of Trustees duly appointed under the said Act.
Schedule
All that piece or parcel of land being portion of the Town Belt of the Town of Port Chalmers, containing by admeasurement five acres, more or less, bounded and admeasured as follows: Commencing at a point distant seven hundred and eight links and five-tenths of a link along a line bearing eighty-four degrees and fourteen minutes from the south-easternmost corner of Section 5, Block II., Lower Harbour West District; thence in a line bearing twenty-five degrees twenty-three minutes for a distance of three hundred and eighteen and three-tenths links, thence in a line seventy-one degrees fifteen minutes for a distance of five hundred and sixty-one links, thence in a line bearing forty-three degrees nine minutes for a distance of two hundred links and nine-tenths of a link, thence in a line bearing three hundred and thirty-eight degrees twenty-nine minutes for a distance of one hundred and seventy-six links, thence in a line bearing forty-eight degrees forty minutes for a distance of one hundred and forty-one links and five-tenths of a link, thence in a line bearing one hundred and two degrees fifty-five minutes for a distance of one hundred and sixty-eight links, thence in a line bearing one hundred and fifty-three degrees fifty-five minutes for a distance of four hundred and thirty-six links and five-tenths of a link, thence in a line bearing two hundred and thirty-eight degrees fifty-five minutes for a distance of four hundred and sixty-one links and six-tenths of a link, thence in a line bearing two hundred and forty-one degrees ten minutes for a distance of eight hundred and eighteen links and two-tenths of a link, thence in a line bearing three hundred and thirty-four degrees fifty-one minutes for a distance of two hundred and twelve links to the point of commencement.
