An Act to set at rest Doubts as to the Boundaries of the Borough of Hamilton.
Preamble.
WHEREAS by Proclamation under the hand of the Governor, dated the twenty-fourth day of December, one thousand eight hundred and seventy-seven, and issued under and by virtue of “The Municipal Corporations Act, 1876,”
a certain portion of the districts of Hamilton East and West was constituted a borough within the meaning of the said Act, and certain boundaries thereof were therein defined: And whereas doubts have arisen as to the extent and accuracy of such boundaries, and the validity of such Proclamation, and it is desirable to set such doubts at rest:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Borough of Hamilton Boundaries Act, 1882.”
2 Borough of Hamilton to be deemed to have been in existence from 24th December, 1877.
The district comprised within the boundaries mentioned and described in the Schedule hereto shall be taken and deemed to be and to have been, as from the twenty-fourth day of December, one thousand eight hundred and seventy-seven, properly constituted a borough, under the name of the Borough of Hamilton, within the meaning of “The Municipal Corporations Act, 1876,”
and the amendments thereto.
All acts and things done, and all proceedings taken, and all contracts entered into, in the name of or on behalf of the said borough since the said date, which would have been lawful if the said borough had been properly constituted and the boundaries thereof correctly defined, are hereby declared to have been and to be valid and effectual to all intents and purposes; and all debts, liabilities, or penalties incurred or accrued since the said date, and now subsisting, may be imposed, recovered, and enforced accordingly.
Schedule Borough of Hamilton
All that parcel of land in the Provincial District of Auckland, bounded towards the North-east by the Waikato River from a stream which forms the South-eastern Borough of Hamilton to be deemed to have been in existence from 24th December, 1877. boundary of Allotment No. 242, Parish of Te Rapa, to the south-eastern boundary-line of Allotment No. 219 produced across the river; thence towards the North-west by that line, and Allotments Nos. 219, 220, 223, a road 100 links wide, Allotment No. 223a; towards the North-east by said Allotment No. 223a, a road 100 links wide, Allotments Nos. 224, 225, 229, 230, and 231, a road 100 links wide, Allotment No. 251, a road 100 links wide, and Allotment No. 254, all in the Parish of Kirikiriroa, to the Waikato River; thence towards the South by the said river to the northern boundary-line of Allotment No. 24 produced across the river; thence by that line and by said Allotment No. 24; towards the East by Allotments Nos. 24 and 25 to a point in line with the northern boundary-line of Allotment No. 26; thence again towards the South by a road 100 links wide, and by said Allotment No. 26, for a distance of 700 links; thence towards the West by a line at right angles to the northern boundary of Allotment No. 26 to the Lake; and towards the West and South by the Lake to Allotment No. 363; thence towards the South by that allotment; towards the West and North by Allotment No. 1, a road 100 links wide, and Allotment No. 2, all in the Parish of Te Rapa aforesaid, to the stream which forms the eastern boundary of Allotment No. 243 of said parish; and thence by that stream to the Waikato River.
