An Act to provide for Leasing certain Portions of the Timaru Market Reserve.
Preamble.
WHEREAS the lands described in the Schedules hereto have been duly reserved as a site for a market for the Borough of Timaru: And whereas it is expedient to empower the Corporation of the said borough to lease the portions of the said land described in the First Schedule for the purpose of providing funds towards the establishment of such market on the lands described in the Second Schedule:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Timaru Market Reserve Act, 1884.”
2 Corporation may lease land.
It shall be lawful for the Corporation of the Borough of Timaru from time to time to let, by public auction or tender, by way of lease, under its corporate seal, at such rent and on and subject to such covenants and conditions as the Council of the said borough may think reasonable, the whole or any part or parts of the lands mentioned in the First Schedule hereto, for any term or terms of years not exceeding twenty-one years at any one time, and with or without a covenant for renewal of the said lease for a further term not exceeding twenty-one years from the expiration of such lease.
3 Proceeds to be applied towards the establishment of a market.
All moneys received by the said Corporation for the rents, issues, and profits of the said lands described in the First Schedule shall, after deducting therefrom all necessary expenses incurred in the management thereof, be applied in and towards the establishment of such market as aforesaid on the lands described in the Second Schedule hereto, and not otherwise.
SCHEDULES
FIRST SCHEDULE
All those parcels of land in the Town of Timaru, containing together 1 acre 3 roods 29 perches, more or less, and numbered respectively as under on the official map in the Survey Office, Christchurch:—One acre and one perch, more or less: Bounded—Northward by the continuation of the southern boundary-line of Browne Street; Westward by Sections Nos. 191 and 198; and South-eastward by a line in line with the south-eastern boundary of Section No. 205, and numbered 2504b (in red). Three roods twenty-eight perches, more or less: Bounded—Eastward by High Street; Southward by a line in line with the northern boundary of William Street; and North-westward by a line in line with the north-western boundaries of Sections Nos. 361 and 322, and numbered 2504o (in red).
SECOND SCHEDULE
ALL that parcel of land in the Town of Timaru, containing 2 acres 1 rood 38 perches, more or less, and numbered 2504a (in red) on the official map in the Survey Office, Christchurch. Bounded—Eastward by High Street; Northward by the continuation of Heaton Street; Westward by Sections Nos. 177 and 184; and Southward by the continuation of the northern boundary-line of Browne Street.
