An Act to authorize the Sale of a Recreation Reserve at the Thames, in order to the acquisition of another in place thereof.
Preamble.
WHEREAS the lands described in the Schedule hereto are vested in the Corporation of the Borough of the Thames for the purpose of a recreation ground for the inhabitants of the said borough, but the same are unsuitable for such purpose as being too far removed from the limits of the said borough, and it is desirable to acquire a more suitable site for the purpose aforesaid:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Thames Recreation Reserve Sale Act, 1884.”
2 Borough Council may sell or exchange reserve.
The Borough Council of the Borough of the Thames—
(1.)
May sell all or any of the lands described in the Schedule, and shall apply the proceeds of every such sale in the acquisition of other lands more suitable for one or more recreation-grounds within or nearer to the aforesaid borough;
(2.)
May exchange all or any of the said lands for other lands more suitable as aforesaid.
Application of proceeds.
Any surplus moneys remaining after the purchase of lands as aforesaid, and any moneys received by way of equality of exchange of the reserve or any part thereof for other lands may be applied by the Borough Council aforesaid in the improvement of the lands acquired by such purchase or exchange.
3 Lands acquired to be subject to same trusts.
All lands to be bought, or to be taken in exchange, under the last-preceding section shall be held by the Corporation of the Borough of the Thames upon the same trusts and for the like purposes as the lands described in the Schedule are now held.
4 Power of sale to expire in five years.
The power hereby given of selling or exchanging the said lands, or any part thereof, shall expire if the same be not exercised within five years from the date of the passing of this Act.
Schedule
All that piece or parcel of land in the Provincial District of Auckland, in the Colony of New Zealand, situate in the Survey District of Thames, County of Thames, containing by admeasurement two hundred (200) acres, be the same a little more or less, and being part of a block of land known as “Ohaene,”
and numbered 2897. Bounded towards the North by part of the said block, 3309 links; towards the East by Te Rapa Block 689 links, 99 links, and 320 links, Te Rapa Stream, and the Whangorahi Block 210 links, 351 links, and 1279 links; towards the South by the Waiwhakaurunga River; towards the South-west by part of the said Ohaene Block, 1380 links; again towards the South by part of the said Ohaene Block, 1200 links, and by the Maeaea Block, 778 links; and towards the North-west by lines 2515 links, 1197 links, and 1836 links: be the said several admeasurements a little more or less.
