An Act to validate Sydenham Municipal Council Public Works Loan.
Preamble.
WHEREAS the Mayor, Councillors, and burgesses of the Borough of Sydenham, hereinafter called “the corporation,”
by the name of “The Sydenham Borough Council,”
lately resolved to borrow by way of special loan, pursuant to “The Municipal Corporations Act, 1876,”
and the Acts amending the same, the sum of twenty-five thousand pounds, for the purpose of constructing concrete side-channelling and kerbing to the footpaths in the streets of the Borough of Sydenham, and for asphalting about one-half of the respective widths of the said footpaths: And whereas the Council of the said corporation duly published in the said borough once in each week during four successive weeks a notice setting forth the particular works proposed to be undertaken, the sum proposed to be borrowed for such purpose, the special rate and rents to be pledged as security for such loan, and not being moneys theretofore pledged as security for any loan or appropriated to any special purpose: And whereas the Mayor of the said borough duly called a meeting of the burgesses of the said borough for a day not more than ten days after the publication of such last notice, to consider the said proposal, and the Mayor presided at such meeting, and, after due consideration and discussion of the proposal, the Mayor gave notice that a poll would be taken on the said proposal on the sixteenth day of February, one thousand eight hundred and eighty-five, being a day not less than one nor more than three weeks from the day of the said meeting on which the said poll was to be taken: And whereas, all proceedings as required by the said Acts having been duly had and taken, the said poll was taken on the day appointed therefor, when the said proposal was duly carried by the requisite number of the votes of the burgesses of the said borough as by law required; and the Mayor forthwith gave public notice of the number of votes recorded for and against the said proposal, and declared the resolution in favour of such proposal to have been duly carried, and the Mayor duly sent a notice of the carrying of such resolution to the Colonial Secretary, who published the same in the New Zealand Gazette of the twenty-sixth day of February, one thousand eight hundred and eighty-five: And whereas doubt has been raised whether such proposal and the publication thereof, and the poll had and taken thereupon, were valid, by reason of the same having been made in the name of “The Sydenham Borough Council,”
instead of in the name of the “Mayor, Councillors, and burgesses of the Borough of Sydenham:”
And whereas it is desirable to remove such doubts:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Sydenham Public Works Loan Validation Act, 1885.”
2 Validation of proceedings.
The proposal herein referred to, and the poll had and taken thereupon, and all subsequent proceedings, shall be good, valid, and effectual in law and in all respects, notwithstanding that the Mayor, Councillors, and burgesses of the Borough of Sydenham, in any notice or proceeding in connection with the said proposal or loan, or the taking of the poll thereon, or any subsequent proceedings in connection therewith, may have been erroneously described as “The Sydenham Borough Council.”
3 “Sydenham Borough Council”
to mean Mayor, Councillors, and burgesses of the Borough of Sydenham.
In all matters and proceedings whatsoever in which the name “Sydenham Borough Council”
has been used instead of the corporate title, “Mayor, Councillors, and burgesses of the Borough of Sydenham,”
the words “Sydenham Borough Council”
shall be taken to be and shall mean and be read as the “Mayor, Councillors, and burgesses of the Borough of Sydenham.”
