An Act to authorize the Sale or Exchange of the North Timaru Cemetery Reserve for other more suitable Lands.
Preamble.
WHEREAS the land described in the Schedule hereto has been set apart as a public cemetery, and the care and management thereof have been vested in Trustees appointed in pursuance of “The Cemeteries Act, 1882:”
And whereas the said land is unsuitable as a place for the interment of the dead, and authority was granted by “The North Timaru Cemetery Sale Act, 1882”
(herein referred to as “the said Act”
), to sell the same as town lands, and efforts have been made in that behalf, which have proved fruitless: And whereas it is desirable that authority should be given to effect a sale or an exchange of the said land as hereinafter mentioned:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The North Timaru Cemetery Sale or Exchange Act, 1886.”
2 Sale or exchange of North Timaru Cemetery Reserve authorized.
The Governor may,—
(1.)
Under the authority of section two of the said Act authorize the Land Board of Canterbury to sell the lands described in the Schedule hereto in such manner as it shall think best, and apply the proceeds in manner mentioned in section three of the said Act; or
(2.)
Under the authority of section four of “The Public Reserves Act, 1881,”
make an exchange of the said land with the owner of any other lands the Trustees aforesaid may think more suitable for a cemetery, and for such purpose may execute any necessary grant or other instrument.
3 Application of land received in exchange.
The land to be acquired under any exchange made under the authority of this Act shall be conveyed and assured to Her Majesty in trust as a site for a public cemetery, to be dealt with under the provisions of “The Cemeteries Act, 1882,”
and shall from the date of such conveyance vest in the Trustees appointed for the maintenance and care of the said cemetery under and for the purposes of the said Act.
4 Proceeds may be invested pending purchase.
Notwithstanding anything contained in the said Act or this Act, the Trustees of the North Timaru Cemetery may invest the proceeds of any sale of the land described in the Schedule hereto in such securities as they shall think most fitting, in case they shall think it not necessary at the present time or for some time to come to apply such proceeds in acquiring further lands for the increase of the present cemetery at Timaru or for providing a second cemetery at such place.
The annual income from any such investment shall be applied towards the maintenance and improvement of the cemetery existing at Timaru at the present time, and for no other purpose.
Schedule Cemetery Site
All that parcel of land in the Arowhenua Survey District, Provincial District of Canterbury, containing 5 acres, more or less. Bounded Northward by Section No. 1701; Eastward by Section No. 965; and Southward and Westward by a road-line: and numbered 146 (in red) on the official map in the Survey Office, Christchurch.
