An Act to authorise the New Plymouth Harbour Board and the Borough of New Plymouth to take Portions of certain Reserves for a New Street, and to authorise the New Plymouth Harbour Board to transfer certain other Portions vested in them to the Borough of New Plymouth.
Preamble.
WHEREAS the New Plymouth Harbour Board, with the consent of the New Plymouth Municipal Corporation, are desirous that a new street should be made through certain reserves belonging to each body: And whereas it has been agreed (subject to the approval of Parliament) between the New Plymouth Harbour Board and the New Plymouth Municipal Corporation that certain small portions of a reserve belonging to the New Plymouth Harbour Board should be transferred to the New Plymouth Municipal Corporation by way of compensation, and in exchange for that portion of the reserve belonging to the New Plymouth Municipal Corporation which is intended to be transferred to the New Plymouth Harbour Board upon trust for the purposes of a new street:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The New Plymouth Borough and Harbour Board Street and Reserve Exchange Act, 1887.”
2 Land in First Schedule belonging to Harbour Board to be for a street.
From and after the passing of this Act the parcels of land described in the First Schedule hereto, and now held by the New Plymouth Harbour Board as a reserve, together with the portions of the original bed of the Mangotuku Stream in such Schedule described, shall be held by the said Board upon trust for the purpose of a street.
3 Land in Second Schedule belonging to Corporation transferred to Harbour Board for a street.
The parcels of land described in the Second Schedule hereto, and now held by the Mayor, Councillors, and burgesses of the Borough of New Plymouth as a reserve for the site of a Town Hall and public lecture-rooms, and as an endowment for the improvement and benefit of the Town of New Plymouth respectively, are hereby transferred to and vested in the New Plymouth Harbour Board upon trust for the purpose of a street.
4 Land in Third Schedule transferred to Corporation as a reserve.
The parcels of land described in the Third Schedule hereto, and now held by the New Plymouth Harbour Board as a reserve, together with the portion of the original bed of the Mangotuku Stream in such Schedule described, are hereby transferred to and vested in the Mayor, Councillors, and burgesses of the Borough of New Plymouth as a reserve and endowment for the improvement and benefit of the Town of New Plymouth.
5 Land in Fourth Schedule transferred to Harbour Board as a reserve.
The parcel of land described in the Fourth Schedule, and now held by the Mayor, Councillors, and burgesses of the Borough of New Plymouth as a reserve for the site of a Town Hall and public lecture-rooms, is hereby transferred to and vested in the New Plymouth Harbour Board as a reserve.
6 Street authorised by this Act may be less than 66 feet.
Notwithstanding anything to the contrary contained in section two hundred and thirty-two of “The Municipal Corporations Act, 1886,”
the Borough Council may, by special order, declare that any land hereby authorised to be held by or vested in the New Plymouth Harbour Board for the purpose of a street shall become a public street, though of less width in some parts than sixty-six feet. Any such special order shall be made in accordance with the provisions of section two hundred and sixty-five of “The Municipal Corporations Act, 1886,”
and as if such land were a private street.

FIRST SCHEDULE
All that piece or parcel of land containing by admeasurement 1 rood 31 perches, more or less, situated in the Borough of New Plymouth, Provincial District of Taranaki, being portion of Mount Eliot New Plymouth Harbour Reserve. Bounded Northerly by St. Aubyn Street, 111.7 links; thence Easterly by part of the said Mount Eliot Reserve, 445–2 links; thence generally Southerly by the Mechanics’ Institute New Plymouth Borough Reserve 27.6 links, and by the original river-bed of the Mangotuku 108 links or thereabouts; thence Westerly by a part of the said Mount Eliot Reserve to the starting-point, 426–45 links.
Also all that piece or parcel of land containing by admeasurement 8 perches, more or less, situated in the Borough of New Plymouth, Provincial District of Taranaki, being portion of the original river-bed of the Mangotuku. Bounded generally Northerly by the Mount Eliot New Plymouth Harbour Reserve, 108 links; Easterly by the Mechanics’ Institute New Plymouth Borough Reserve, 140 links or there abouts; thence generally Westerly and Southerly by other portion of the said riverbed, 29 links; by Section No. 630, 140 links; and by said river-bed, 15 links, to the starting-point.
Also all that piece or parcel of land containing by admeasurement 4 perches, more or less, situated in the Borough of New Plymouth, Provincial District of Taranaki, being portion of Section No. 630. Bounded generally Northerly and Easterly by the original river-bed of the Mangotuku, 140 links or thereabouts; Westerly by part of the said section to the starting-point, 100 links.
Also all that piece or parcel of land containing by admeasurement 1 rood, more or, less, situated in the Borough of New Plymouth, Provincial District of Taranaki, being portion of Mount Eliot New Plymouth Harbour Reserve. Bounded Northerly by a part of the said Mount Eliot Reserve, 294.26 links; thence Easterly by the New Plymouth Borough Street Reserve, 90 links; thence Southerly by another portion of the said Mount Eliot Reserve, 209–98 links; thence Westerly by part of the Mechanics’ Institute New Plymouth Borough Reserve to the starting-point by lines 72.9 and 50.5 links respectively.
Also all that piece or parcel of land containing by admeasurement 1 rood, more or less, situated in the Borough of New Plymouth, Provincial District of Taranaki, being portion of Section No. 644. Bounded Northerly by King Street, 103.75 links; thence Easterly by Section No. 645, 260 links; thence Southerly by Devon Street, 71.2 links; thence generally Westerly by the original river-bed of the Mangotuku, 115 links or thereabouts; ‘thence again Westerly by part of said Section No. 644 to the starting-point, 180 links.
Also all that piece or parcel of land containing by admeasurement 3 perches, more or less, situated in the Borough of New Plymouth, Provincial District of Taranaki, being part of the original river-bed of the Mangotuku. Bounded generally Easterly by Section No. 644, 119 links or thereabouts; thence generally Westerly by Section No. 652 and a portion of the original river-bed of the Mangotuku to the starting-point, 120 links or thereabouts.
Also all that piece or parcel of land containing by admeasurement 1 perch, more or less, situated in the Borough of New Plymouth, Provincial District of Taranaki, being portion of Section No. 652. Bounded Easterly by the original river-bed of the Mangotuku, 60 links or thereabouts; thence Southerly by Devon Street, 28.8 links; thence Westerly by a portion of the said Section No. 652 to the commencing-point, 50 links.
SECOND SCHEDULE
All that piece or parcel of land containing by admeasurement 1 rood 3 perches, more or less, situated in the Borough of New Plymouth, Provincial District of Taranaki, being portion of the Mechanics’ Institute New Plymouth Borough Reserve. Bounded generally Northerly and Easterly by Mount Eliot New Plymouth Harbour Reserve, by lines 27.6, 46.9, 47.7, 50.5, and 72.9 links respectively; thence Southerly by another portion of the Mechanics’ Institute Reserve, 132 links; thence again Easterly by the said reserve, 74.72 links; thence again Southerly by King Street, 110.04 links; thence generally Westerly by part of the same Mechanics’ Institute Reserve and the original river-bed of the Mangotuku to the starting-point, 232 links or thereabouts.
Also all that piece or parcel of land containing by admeasurement 14.4 perches, more or less, situated in the Borough of New Plymouth, Provincial District of Taranaki, being a New Plymouth Borough Street Reserve. Bounded Northerly by Mount Eliot New Plymouth Harbour Reserve, 100 links; thence Easterly by Brougham Street, 90 links; thence Southerly by another portion of the said Mount Eliot Reserve, 100 links; thence Westerly by another portion of the said Mount Eliot Reserve to the starting-point, 90 links.
THIRD SCHEDULE
All that piece or parcel of land containing by admeasurement 4 perches, more or less, situated in the Borough of New Plymouth, Provincial District of Taranaki, being portion of the original river-bed of the Mangotuku. Bounded Northerly by a portion of the said river-bed, 27 links or thereabouts; thence Easterly by part of the Mechanics’ Institute New Plymouth Borough Reserve, 105 links or thereabouts; thence Southerly by King Street, 25 links; thence Westerly by part of Section No. 630 to the starting-point, 100 links or thereabouts.
Also all that piece or parcel of land containing by admeasurement 4 perches, more or less, situated in the Borough of New Plymouth, Provincial District of Taranaki, being portion of Section No. 630. Bounded Northerly by another part of the said Section No. 630, 76 links; thence Easterly by the original river-bed of the Mangotuku, 100 links; thence Westerly by another portion of the said Section No. 630 to the starting-point, 63.7 links.
Also all that piece or parcel of land containing by admeasurement 32 perches, more or less, situated in the Borough of New Plymouth, Provincial District of Taranaki, being portion of Mount Eliot New Plymouth Harbour Reserve. Bounded Northerly by part of the said Mount Eliot Reserve, 206.2 links; thence Easterly by another portion of the said reserve, 91 links; thence Northerly by the said reserve, 3.78 links; thence again Easterly by a New Plymouth Borough Reserve, 36.7 links; thence again Southerly by King Street, by lines 25 and 65 links respectively; thence Westerly by the Mechanics’ Institute New Plymouth Borough Reserve to the commencing-point, 182.1 links.
FOURTH SCHEDULE
All that piece or parcel of land containing by admeasurement 1.8 perches, more or less, situated in the Borough of New Plymouth, Provincial District of Taranaki, being portion of the Mechanics’ Institute New Plymouth Borough Reserve. Bounded Northerly by Mount Eliot New Plymouth Harbour Reserve, 66.9 links; thence Southerly by a part of the said Mechanics’ Institute Reserve, 47.71 links; thence Westerly by another part of the said Mechanics’ Institute Reserve to the starting-point, 46.9 links.
