An Act empowering the Governor to grant certain Land to Francis Wallace MacKenzie, of Waipahi.
Preamble.
WHEREAS the land described in the Schedule hereto formed part of an area of twenty acres and twenty-five perches of land taken for railway purposes by Proclamation dated the fifth day of August, one thousand eight hundred and eighty one, and published in the New Zealand Gazette of the eleventh day of August, one thousand eight hundred and eighty one, which said land was surrendered for such purpose to Her Majesty free of all claim for compensation by the then owner thereof, Francis Wallace MacKenzie, of Waipahi, late Captain in Her Majesty’s Army: And whereas the portion of the said land described in the Schedule hereto containing thirty and five-tenths perches is no longer required for railway purposes, and it is desirable to re-vest the same in Francis Wallace MacKenzie, of Waipahi, as aforesaid:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The MacKenzie Land Act, 1888.”
2 Governor may grant land to F. W. MacKenzie.
The Governor may, by warrant under his hand, direct the District Land Registrar at Dunedin to issue a certificate of title to the aforesaid Francis Wallace MacKenzie, of Waipahi, in the Land District of Otago, for the land described in the Schedule hereto.
Schedule
All that parcel of land containing by admeasurement 30.5 perches, situate in the Glenkenich Survey District, Land District of Otago, being portion of Section No. 13, Block XI., Glenkenich District, taken by Proclamation for railway purposes, the north-eastern corner of which is situate at a point distant 1377·8 links from Trig. A, bearing N. 4° 18′ W.; and is bounded on the north by a line bearing due west, for a distance of 120·5 links; on the west by a line bearing S. 1° 29′ W., for a distance of 175·4 links to the boundary-line between Sections 12 and 13; on the south by Section 12, for a distance of 80.8 links; on the south-east by Ford Road on a bearing of N. 30° 19′ E., for a distance of 73·3 links; thence on the east by a line bearing N. 3° 27′ 30″ E., for a distance of 113·3 links to the point of commencement: as the same is more particularly delineated upon the plan marked P.W.D. 15146, deposited in the office of the Minister for Public Works, at Wellington, and thereon coloured red.
