An Act for the Transfer of the Athenæum Reserve at Queenstown, in the Lake County, to the Corporation of the Borough of Queenstown.
Preamble.
WHEREAS by grant from the Crown, bearing date the eleventh day of July, one thousand eight hundred and seventy-six, the piece of land described in the Schedule to this Act was granted to the Super intendent of the late Province of Otago and his successors in that office in trust as a site for an Athenæum for the Town of Queenstown: And whereas by “The Queenstown Athenæum Act, 1877,”
the said site was vested for a like purpose in Trustees as a body corporate; and it has been agreed by and between the said Trustees and the Borough Council of Queenstown (herein called “the Council”
) that the said land, together with all other property of the Trustees, should be transferred to the Corporation of the borough, with a view of the future maintenance of the said Athenæum as a free library:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Queenstown Athenæum Act, 1889.”
It shall come into operation on the first day of October next after the passing thereof.
2 Athenæum reserve vested in Corporation of Queenstown.
On the day of the commencement of this Act the land described in the Schedule hereto, together with all buildings and erections thereon, shall, without any conveyance, be and the same is hereby vested in the Corporation of the Borough of Queenstown, and the same shall be held by it in trust as a reserve for an Athenæum and Free Library for the Town of Queenstown (hereinafter called “the Athenæum”
).
3 Books, furniture, and other property of Athenæum transferred to Corporation.
On and after the aforesaid commencement,—
Debts, claims, and liabilities of Athenæum to be debts, &c., of Corporation.
(1.)
All books, furniture, moneys, and other property of every kind held by the Trustees of the Queenstown Athenæum on behalf of the said Athenæum are hereby transferred to, and from the aforesaid day shall belong to, the aforesaid Corporation; and
Moneys due to Athenæum to be paid to Corporation.
(2.)
All debts, claims, and liabilities of every kind of the aforesaid Trustees on account of the said Athenæum shall be the debts, claims, and liabilities of the said Corporation, and shall be discharged by the Borough Council on behalf of the Corporation.
(3.)
All moneys due, or to be due, to the aforesaid Trustees (if any) shall be payable to and be paid by the several persons owing the same to the Borough Council of Queenstown, and shall form part of the Borough Fund.
4 Statement of accounts.

The Trustees of the aforesaid Athenæum forthwith after the commencement of this Act shall prepare a balance-sheet showing their assets and liabilities on account of the said Athenæum on the day of the commencement of this Act, which shall be under their seal, and shall submit the same to the Borough Council of Queenstown, and at the same time shall pay to the said Council all moneys (if any) in their hands belonging to the said Athenæum; and, on approval of the said balance-sheet by the Borough Council, and on payment of the aforesaid moneys (if any), the said Trustees shall be and are hereby discharged and exonerated from their trust.
5 Management of Athenæum as a free library.
The Borough Council shall have the control and management of the Athenæum, and shall maintain in connection therewith a free public library under “The Public Libraries Act, 1869.”
6 Maintenance of library under the Public Libraries Act.
The Act last named is hereby adopted within the Borough of Queenstown, and shall have the same force as if adopted by a vote of the ratepayers under section five of the said Act, for all purposes of the control and management of the said library, and of levying a library rate under the said Act in support thereof, not exceeding however the limit fixed by the said Act.
7 Repeal.
“The Queenstown Athenæum Act, 1877,”
is hereby repealed.
Schedule
All that piece or parcel of land in the Provincial District of Otago, in the Colony of New Zealand, containing by admeasurement twenty-three poles, more or less, situate in the Borough of Queenstown, being Section numbered seven (7), Block thirty-one (XXXI.), on the map of the said town. Bounded towards the north-west by Ballarat Street, sixty-nine links; towards the north-east by Stanley Street, two hundred and nine links; towards the south-east by Section numbered 5, sixty-nine links; and towards the south-west by Section numbered 8 and by a portion of the Camp Reserve, two hundred and nine links.
