An Act to empower the Auckland Harbour Board to convey certain Portions of the Foreshore of the Harbour of Auckland in Performance of certain Contracts and Promises.
Preamble.
WHEREAS by deed of conveyance dated the twentieth day of August, one thousand eight hundred and eighty-one, made between Thomas Buddle, William Scott Wilson, and Joseph Liston Wilson, trustees under the will of William Chisholm Wilson, late of Auckland, newspaper proprietor, deceased, of the one part, and the Auckland Harbour Board of the other part, the said Thomas Buddle, William Scott Wilson, and Joseph Liston Wilson conveyed to the Auckland Harbour Board all that piece of land in the Provincial District of Auckland containing by admeasurement four acres and twenty perches, more or less, and being part of allotment number thirty-two and part of allotment number thirty-three of section two of the Parish of Takapuna, County of Eden, together with all riparian rights and rights of access to and from the Waitemata Harbour to and from said allotment number thirty-three, or any part thereof of said section two as may extend along or be parallel with a road proposed to be laid out along and upon the foreshore:
And whereas, in consideration of the surrender of such riparian rights and rights of access as aforesaid, it was by the said deed covenanted and agreed that in the event of the Harbour Board reclaiming any portion of the foreshore fronting said allotment thirty-three and laying out and constructing a roadway thereon, the said Auckland Harbour Board should, as soon thereafter as practicable, use their best endeavours to obtain power, by legislative enactment, to enable the Auckland Harbour Board to convey to the said Thomas Buddle, William Scott Wilson, and Joseph Liston Wilson, their heirs or assigns, all the land lying between the northern side of the said road so laid out and constructed as aforesaid and the southern boundary of said allotment thirty-three, thereby giving a road-frontage for a water-frontage, and immediately upon obtaining such authority should convey to the said Thomas Buddle, William Scott Wilson, and Joseph Liston Wilson the said last-mentioned piece of land: And whereas the foreshore fronting said allotment thirty-three has been reclaimed from the sea by the Auckland Harbour Board, and the said Thomas Buddle, William Scott Wilson, and Joseph Liston Wilson have requested the Auckland Harbour Board to obtain power and authority to convey the said piece of land:
And whereas by deed dated the twenty-ninth day of October, one thousand eight hundred and eighty-eight, and made between the Auckland Harbour Board of the one part, and the Mayor, Councillors, and Burgesses of the Borough of Devonport of the other part, the Auckland Harbour Board, in consideration of the Mayor, Councillors, and Burgesses of the said borough permitting the Auckland Harbour Board to lay out certain roads in Shoal Bay, adjoining the Borough of Devonport, without forming or contributing to the cost of formation of such roads, and in lieu of such formation or contribution, agreed to convey to the said Mayor, Councillors, and Burgesses all those pieces or parcels of land described in the Second Schedule hereto: And whereas it is desirable that the Auckland Harbour Board should be empowered to make the conveyances hereinbefore mentioned:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Auckland Harbour Board Empowering Act, 1890.”
2 Interpretation.
In this Act, if not inconsistent with the context, where the following terms are used they shall have the meanings hereinafter stated, that is to say:—
“The Board” shall mean the Auckland Harbour Board:
“The trustees” shall mean the said Thomas Buddle, William Scott Wilson, and Joseph Liston Wilson, or the trustees for the time being of the will of the said William Chisholm Wilson:
“The Corporation” shall mean the Corporation of the Mayor, Councillors, and Burgesses of the Borough of Devonport.
3 Board may convey certain land.
The Board may, and it is hereby authorised and empowered to, convey to the trustees all that piece or parcel of land described in the First Schedule hereto, and to lay out and construct a road as aforesaid on the said reclaimed land.
4 Board may convey certain lands.
The Board may, and it is hereby authorised and empowered to, convey to the Corporation all those pieces or parcels of land described in the Second Schedule hereto.
SCHEDULES
FIRST SCHEDULE
All that area in the Provincial District of Auckland, containing by admeasurement 2 roods 6 perches, more or less, being land reclaimed from the Harbour of Auckland. Bounded by a line commencing at the south-west corner of Lot 24a of Section 2 of the Parish of Takapuna, and bearing N. 75° 48′ W., 848 links, being frontage to a road; thence by the southern boundary of a portion of Allotment 33 of said Section 2, being the original boundary at high-water mark of said Allotment 33, to the starting-point.
SECOND SCHEDULE
All that area in the Provincial District of Auckland, containing by admeasurement 22 acres 2 roods and 30 perches, more or less, and being portion of Shoal Bay, in the Harbour of Auckland. Bounded by a line commencing at a point on the southeastern boundary of Lot 1 of Section 1, Parish of Takapuua, 170 links from its easternmost angle, and proceeding along a line bearing S. 58° 13′ E., 779 links, being the frontage to the Narrow Neck Road; thence by lines bearing and measuring respectively S. 39° 16′ W., 514 links, S. 14° 59′ W., 841 links, and S. 4° 19′ E., 568 links, being frontage to a road; thence by a line bearing N. 75° 02′ W., 1913 links, being frontage to a road; thence by lines bearing and measuring respectively N. 31° 48′ E., 140 links, N. 51° 52′ E., 1440 links, N. 34° 55′ E., 836 links, to the starting-point; be all the aforesaid linkages more or less: as the same is delineated and marked A on plan deposited in the District Land Registry Office at Auckland as No. 693.
All that area in the Provincial District of Auckland, containing by admeasurement 2 acres 1 rood 15 perches, more or less, and being portion of Shoal Bay, in the Harbour of Auckland. Bounded by a line commencing at peg No. VI., on Plan No. 693, deposited in the District Land Registry Office at Auckland, and proceeding along lines bearing and measuring respectively S. 51° 45′ E., 656 links, S. 29° 23′ W., 176 links, and S. 85° 48′ W., 600 links, all having a frontage to a road; thence by a line bearing N. 15° 41′ E., 627 links, to peg No. VI. aforesaid, the starting-point; be all the aforesaid linkages more or less: as the same is delineated and marked B on said Plan No. 693.
