An Act to change the Purpose of a Public Reserve in the Vicinity of Mount Eden and Suburbs of the City of Auckland.

Preamble.

WHEREAS the lands described in the Schedule hereto, consisting of thirty-eight acres one rood and sixteen perches, more or less, in the suburbs of the City of Auckland, in the County of Eden, were, by Proclamation of the then Superintendent of the Province of Auckland, dated the tenth day of October, in the year one thousand eight hundred and seventy-four, set apart, together with many other lands in the said province, as an endowment for or towards the maintenance and support of the lunatic and other asylums within the said province:

And whereas the said lands are now vested in Her Majesty the Queen, for the purposes aforesaid, under the provisions of “The Abolition of Provinces Act, 1875:”

And whereas it is expedient to make provision for a site for the erection of an asylum for the blind on a part of the said lands:

And whereas the population on the southern side of Mount Eden has greatly increased, and it is desirable that open spaces in the neighbourhood thereof should be kept open, and it is also desirable to provide a public recreation-ground for the use of the inhabitants of the Epsom and Mount Eden districts, and no suitable public lands in the vicinity of the said districts other than the lands described in the Schedule remain available for the purpose, except a small paddock known as the Epsom Domain; and it is also desirable to set apart a portion of the said lands for a gravel-pit:

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

The Short Title of this Act is “The Epsom and Mount Eden Reserve Act, 1890.”

2 Lands to be vested in Trustees for

The lands described in the Schedule hereto shall no longer be appropriated as an endowment for the purposes hereinbefore recited, but shall, as and from the commencement of this Act, become and be vested in the Trustees hereinafter mentioned for the public purposes following, that is to say,—

Site for Blind Asylum;

(1.)

As to the lands first described in the Schedule, as a site for an asylum for the blind, and shall be held for such purpose in fee-simple by such Trustees or other persons or corporate body in whom the Governor is hereby authorised and may by Proclamation in the Gazette vest the same for the above purpose; and

Recreation-ground for Epsom and Mount Eden districts;

(2.)

As to the lands secondly described in the Schedule, as a public recreation-ground, and shall be held for such purpose by the Trustees mentioned in the next section, subject to the provisions of “The Public Domains Act, 1881,” and “The Public Domains Act 1881 Amendment Act, 1885;” and

Gravel-pit.

(3.)

As to the lands thirdly described in the Schedule, as a reserve for a gravel-pit or quarry for the Road Boards of the Epsom, Mount Eden, One-tree Hill, and Eden Terrace Road Districts respectively, and for the Borough Council of Newmarket, and shall be held and managed by the last-mentioned Trustees for such purpose only.

3 Recreation-ground and Gravel-pit Trustees appointed.

The Chairman of the Epsom Road Board and the Chairman of the Mount Eden Road Board for the time being, together with two other members of the Epsom Road Board and two other members of the Mount Eden Road Board, to be elected by the same Boards respectively, shall together form the Board of Trustees for the above-mentioned recreation-ground and gravel-pit.

And the said Trustees shall be deemed to be a Public Domain Board, and shall have all the powers which the Governor may delegate under “The Public Domains Act, 1881.”

The elective Trustees shall be chosen by the said Road Boards as soon after the passing of this Act as may be; and the Trustees so elected shall hold office until they vacate their office as members of the aforesaid Road Boards respectively, whereupon, and as often thereafter as it may become necessary, new Trustees shall be elected from and by the then members of the said Road Boards to fill the places of any Trustees so vacating office.

Schedule Site for Blind Asylum.

All that piece or parcel of land, containing by admeasurement 5 acres more or less, in the Suburbs of Auckland, being part of Allotment No. 46 of Section No. 6 of the suburbs aforesaid. Bounded towards the north by portion of Allotment No. 46, 1150 links; towards the south-east and north-east by a road 100 links wide, 13 links and 424 links respectively; towards the south by Allotment No. 182 of Section No. 10 of the aforesaid suburbs, 1303 links; and towards the west by a line running northerly at right angles to the last-mentioned boundary, 408·6 links: be all the aforesaid linkages more or less.

Recreation-ground.

All that piece or parcel of land, containing by admeasurement 29 acres 3 roods and 16 perches, more or less, in the Suburbs of Auckland, being part of Allotment No. 46, Allotment No. 49, and part of Allotment No. 48 of Section No. 6 of the suburbs aforesaid. Bounded towards the north-east by a road, 405 links; towards the south-east, north-east, and north-west by other portion of Allotment No. 48 aforesaid, 500 links, 700 links, and 500 links respectively; again towards the north-east by the aforesaid road, 210 links; again towards the south-east and north-east by Allotment No. 45 of Section No. 6 aforesaid, 893 and 1370 links respectively; again towards the south-east by a road, 553 links; towards the south-west and again towards the south-east by other portion of Allotment No. 46, 1150 links and 408·6 links respectively; again towards the south-east by Allotment No. 182 of Section No. 10 of the said suburbs, 40 links; again towards the south-west by the abutment of a road, and by Allotment No. 68 of Section No. 10 aforesaid, 1735 links; and again towards the north-west and south-west by a road, 407 links, 555 links, 300 links, 332 links, and 420 links: be all the aforesaid measurements a little more or less.

Gravel-PIT Reserve.

All that piece or parcel of land, containing by admeasurement 3 acres 2 roods, more or less, in the Suburbs of Auckland, being part of Allotment No. 48 of Section No. 6 of the suburbs aforesaid. Commencing at a point along a line of road distant 405 links from the northern corner of the said allotment; and bounded towards the north-east by a road, 700 links; and towards the south-east, south-west, and north-west by other portion of Allotment No. 48 aforesaid, 500 links, 700 links, and 500 links respectively: be all the aforesaid measurements a little more or less.
