An Act to provide for the Surrender of a Lease of Crown Land available for Settlement at Kaimarama, near Mercury Bay.
Preamble.
WHEREAS certain blocks of Native land known as the Kaimarama Block (No. 1966), the Ounuora No. 2 Block (No. 1959), and the Rangihau Block (No. 2286), all in the vicinity of Mercury Bay, have been, the one in part and the others entirely, acquired by Her Majesty from the Native owners thereof respectively, subject, however, to certain leases which had previously to such acquisition been granted by the said Native owners to a certain timber company, known as the Mercury Bay Timber Company:
And whereas it is desirable to obtain for purposes of settlement the Kaimarama Block, the land whereof is in a great part suitable for such purposes, the timber thereon having been mostly removed: And whereas the aforesaid company, holding a lease of the said block for a period of 99 years dating from October 11, 1870, are willing to surrender such lease to Her Majesty in consideration of having their several leases of the Ounuora Block, which is for a term of 21 years dating from May 1, 1872, and of the Rangihau Block, which is for a term of 21 years dating from December 27, 1873, respectively, extended for a further period of ten years from the date of the expiration of the said leases, subject to the same rents and conditions:
And whereas it is expedient to authorise the Governor to effect the proposed arrangement, whereby suitable land for settlement will be available:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Kaimarama Land Act, 1890.”
2 Governor may negotiate with Mercury Bay Timber Company for surrender of lease of land suitable for settlement.
If at any time before the expiration of twelve months from the date of the passing of this Act the Mercury Bay Timber Company, or their assigns, shall surrender to Her Majesty the lease they hold over the Kaimarama Block of land, as defined in the First Schedule hereto, and all their rights under the said lease, then and in such case the Governor, in the name of Her Majesty, and in consideration of the aforesaid surrender, may grant to the said company, or their assigns, an extension of the leases they hold over the Ounuora No. 2 and Rangihau Blocks of land, as the same are defined in the Second Schedule hereto, for a period not exceeding ten years, to date respectively from the first day of May, one thousand eight hundred and ninety-one, in the case of the Ounuora No. 2 Block, and from the twenty-seventh day of December, one thousand eight hundred and ninety-four, in the case of the Rangihau Block, subject to the same rent and conditions as contained in their now current leases of such lands respectively.
But no further extension of the aforesaid leases, or either of them, shall be made to the said company.
3 On surrender, land to be open for settlement under Land Act.
On the surrender of the lease of the Kaimarama Block aforesaid, the land comprised therein shall be deemed to be Crown lands open for settlement under “The Land Act, 1885,”
in any manner the Governor may think fit to dispose of the same.
SCHEDULES
FIRST SCHEDULE Kaimarama (No. 1966) Block (Part of).
All that area in the Land District of Auckland, situate in the Survey Districts of Coromandel and Hastings, being portion of the Kaimarama (No. 1966) Block, containing by admeasurement 6,700 acres, more or less. Bounded towards the north by Section No. 5, Block XVI., Coromandel Survey District, and Weiti (No. 3) Block; towards the east by other part of the said Kaimarama (No. 1966) Block, containing 1,600 acres; towards the south-east by the Ounuora (No. 1959) Block, 43169 links, and by lines 7085 links; thence towards the south and south-west by lines 22593 links; and thence towards the north-west by the Mahakirau Block to Section No. 5, Block XVI., Coromandel Survey District aforesaid: be all the aforesaid linkages more or less.
SECOND SCHEDULE Ounuora No. 2 Block (No. 1959)
All those areas in the Land District of Auckland, situate in the Survey Districts of Hastings, Coromandel, Mercury Bay, and Whitianga, containing together by admeasurement 5,093 acres, more or less, and being the Ounuora No. 2 Block, one portion of which is bounded towards the north-east by the Miro (No. 2170) Block; towards the east by the Whitianga River and a line crossing the Owhero Creek, 2449 links; thence by a line 6900 links; toward the south and south-west by the Ounuora Creek and the Ounuora (No. 1194) Block; and towards the north-west by the Kaimarama (No. 1966) Block. The other portion is bounded towards the north-west by the Kaimarama (No. 1966) Block; towards the south-east, north-east, and again towards the north-west respectively by the Ounuora (No. 1194) Block; again towards the south-east by the Marokoka (No. 5701) Block and the Taranoho (No. 1972) Block; towards the south, west, and north by the Waikawau (No. 2555) Block; and again towards the north-west and north by the Kaimarama Block to the place of commencement: excepting from the above-described area the Whanauroroa (No. 1960) Block, and an area of 25 acres, more or less, delineated on the plan drawn on the deed of conveyance to the Crown.
Rangihau (No. 2286) Block
All that area in the Land District of Auckland, situate in the Survey Districts of Hastings and Whitianga, being the Rangihau (No. 2286) Block, containing by admeasurement 9,000 acres, more or less. Bounded towards the north and west by the Waiwawa (No. 1967) Block; towards the east by the Rangihau Creek and the Kapowai (No. 1958) Block; towards the south-east and south generally bv Te Pipi (No. 3736) Block; and again towards the west by the Waiwhakaurunga (No. 2516) Block and the Waikawau (No. 2555) Block, to the Waiwawa (No. 1967) Block aforesaid.
