An Act to authorise the Sale of the Omaka Recreation Reserve in the Marlborough County.
Preamble.
WHEREAS the land described in the Schedule hereto has been duly reserved for the purpose of public recreation, and the said land has been found to be unsuitable for such purpose: And whereas the land is now vested in Her Majesty, and it is expedient that the same should be sold:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Omaka Recreation Reserve Sale Act, 1890.”
2 Governor may authorise sale of land.
The Governor may authorise the Commissioner of Crown Lands for the Marlborough Land District to sell and dispose of, either together or in lots, by public auction or by public tender, as he may think fit, the land described in the Schedule hereto.
3 Governor may issue Crown grants.
The Governor may issue such Crown grants, and do, execute, and perform the several acts, deeds, matters, and things necessary to give effect to the sale authorised by this Act.
4 Purchase of recreation reserve.
All moneys received from the sale of any of the said land shall, after the deduction therefrom of the expenses of survey and sale, he held by the Receiver of Land Revenue in deposit account, and shall be applied by the Governor on behalf of Her Majesty in the purchase and improvement of land, in or adjacent to the Town of Blenheim, which the Governor shall deem suitable for the purposes of a recreation reserve.
5 Recreation reserve vested in Her Majesty.
All land obtained by such purchase by Her Majesty shall he conveyed or transferred to Her Majesty, and shall be held by Her Majesty for the same objects and purposes and upon the same trusts as the land described in the Schedule hereto was held immediately before the passing of this Act.
Schedule
All that parcel of land in the Provincial District of Marlborough, containing by admeasurement 270 acres, more or less, situate in the District of Omaka, and being Section No. 31 and part 2 of Section No. 33 on the plan of the said district. Bounded towards the north 3750 links by Sections numbered respectively 32 and 30 on the said plan, and 1900 links by a public road 75 links wide; towards the cast by the River Taylor; towards the south, 700 links and 3750 links, by a public road 75 links wide; and towards the west 5500 links by part 1 of Section No. 33 on the said plan.
