An Act to make Grants of certain Lands in Pukekohe West which have been resumed by Her Majesty as Derelict.
Preamble
WHEREAS lots number eighty and number eighty-one of section number two, in the Parish of Pukekohe West, each containing ten acres, more or less, were allotted to James McCabe, senior, and James McCabe, junior, under “The New Zealand Settlements Act, 1863,”
and the said lands having been abandoned by the aforesaid persons were resumed by Her Majesty as derelict lands under the authority of paragraph eight to the Schedule of “The Special Powers and Contracts Act, 1885,”
and were subsequently, in error, set apart as a recreation reserve, and vested in the Pukekohe Domain Board, under “The Public Domains Act, 1881,”
who granted a lease of the said reserve subject to certain conditions for the fencing and improving thereof:
And whereas the above-named persons have petitioned Parliament for the restoration of the said lands, stating in their petition that they never abandoned the said lands, that their absence was temporary only and with the consent of the authorities, and that they proposed to resume their occupation thereof, and the Waste Lands Committee have reported that they considered their claim good; and it is expedient to make provision for restoring the said lands to them:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The McCabe Land-grants Act, 1891.”
2 Governor may revoke reservation and grant certain lands to McCabe senior and junior.
Proviso.
It shall be lawful for the Governor at any time after the passing of this Act to revoke the reservation as a recreation reserve of the lands described in the recitals hereto, made on the eleventh day of October, one thousand eight hundred and eighty-six, and to grant to the said James McCabe, senior, and James McCabe, junior, such one of the aforesaid lots number eighty and number eighty-one as was originally allotted to them respectively; and the said grantees shall hold the lands so granted to them respectively subject to any lease that may have been made thereof by the Pukekohe Domain Board, and may be still subsisting; and shall not be entitled to claim or be awarded any compensation whatever by reason of the aforesaid lands having been so reserved as aforesaid.
