An Act to reconstitute the Wanganui Harbour and River Conservators Board under the Name of the Wanganui Harbour Board.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Wanganui Harbour Board Act, 1893.”
2 This Act deemed a special Act.
This Act shall be and be deemed to be a special Act within the meaning of “The Harbours Act, 1878,”
which Act, and all the Acts incorporated with or amending the same, shall be incorporated with this Act, so far as the provisions thereof are not inconsistent herewith or repugnant hereto.
3 Interpretation.
In this Act, if not inconsistent with the context,—
“The Board” means the Wanganui Harbour Board, as constituted under this Act:
“The said Act” means “The Harbours Act, 1878,” and all Acts amending the same.
4 Repeal.
So much of the Second Schedule of the said Act as relates to the constitution of the Wanganui Harbour and River Conservators Board is hereby repealed.
5 Constitution of Board.
The Wanganui Harbour Board shall be and be deemed to be a Harbour Board constituted under the said Act and this Act, and shall, in respect of all real and personal property, rights, claims, jurisdiction, obligations, liabilities, contracts, and engagements, and for all purposes whatsoever in law or in equity, be and be deemed to be the same Board as the Wanganui Harbour and River Conservators Board constituted under “The Wanganui Harbour and River Conservators Board Act, 1876,”
and under the said Act.
6 Vacation of office by Wanganui Harbour and River Conservators Board.
The members of the Wanganui Harbour and River Conservators Board at the time this Act shall come into operation shall continue to hold office until the second Monday in the month of February, in the year one thousand eight hundred and ninety-five, on which day they shall go out of office; but any vacancies occurring prior to such last-mentioned date shall be filled up as if this Act had not been passed.
7 Members of Board.
The Board shall, from and after the second Monday in the month of February, in the year one thousand eight hundred and ninety-five, consist of ten members, of whom four shall be non-elective and six elective members.
8 Non-electivc members. Elective members.
The following persons shall be non-elective members of the Board: that is to say, the several persons for the time being holding the offices of Mayor of the Borough of Wanganui, Chairman of the Council of the County of Wanganui, Chairman of the Council of the County of Waitotara, and Collector of Customs for the Port of Wanganui. The elective members shall consist of the following persons: Four persons qualified to be Councillors for the Borough of Wanganui, one person qualified to be a member of the County Council of the County of Wanganui, and one person qualified to be a member of the County Council of the County of Waitotara, to be elected by the ratepayers of the Borough of Wanganui and the Counties of Wanganui and Waitotara respectively.
9 Election of members.
On the second Monday in the month of February, in every alternate year, there shall be an election of the elective members of the Board, and the first election of such members shall be held on the second Monday in the month of February, in the year one thousand eight hundred and ninety-five, and such members shall come into office on their election, and shall hold office from the time of election until the election of their successors.
