An Act to enable the Hawera Borough Council to convey a Portion of a certain Reserve of Land to the Taranaki Hospital and Charitable Aid Board for the Purpose of establishing an Hospital at Hawera.
Preamble.
WHEREAS certain lands, including the lands described in the Schedule hereto, were by deed of grant dated the eighth day of March, one thousand eight hundred and seventy-seven, granted to the Town Board of Hawera as an endowment for Town purposes: And whereas on the constitution of the Borough of Hawera the said lands became vested by operation of law in the Corporation of the Mayor, the Councillors, and Burgesses of the Borough of Hawera: And whereas by private subscription and otherwise a sum of five hundred pounds or thereabouts was some time since raised in the Borough of Hawera, and the same is now held by Trustees upon trust to hand the same to the Taranaki Charitable Aid Board constituted under “The Hospitals and Charitable Institutions Act, 1885,”
for the purpose of establishing a general hospital at Hawera: And whereas the said Board are willing to establish such general hospital, provided the Hawera Borough Council will agree to the lands described in the Schedule hereto being vested in the said Hospital and Charitable Aid Board of Taranaki: And whereas it is expedient to enable the Hawera Borough Council in that behalf:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Hawera Borough Council Enabling Act, 1893.”
2 The Hawera Borough Council may convey land to the Taranaki Hospital and Charitable Aid Board.
It shall be lawful for the Hawera Borough Council, notwithstanding the provisions of the “The Public Reserves Act, 1881,”
or any other Act, to convey and assure the lands described in the Schedule hereto unto the Taranaki Hospital and Charitable Aid Board constituted under “The Hospitals and Charitable Institutions Act, 1885,”
to be held by the said Taranaki Hospital and Charitable Aid Board for the purposes of a general hospital at Hawera, subject to the provisions of “The Hospitals and Charitable Institutions Act, 1885.”
Schedule
All that piece or parcel of land, situate in the Land District of Taranaki and Colony of New Zealand, containing by admeasurement 5 acres, be the same a little more or less, being part of Section No. 30, Town of Hawera. Bounded on the north by a public street, 741 links; on the east by Section 33, 675 links; on the south by a line parallel to the first-mentioned boundary-line, 740.5 links; and on the west by a public street, 675 links.
