An Act to vest certain Lands at Kaiapoi, in the Provincial District of Canterbury, in the Mayor, Councillors, and Burgesses of the Borough of Kaiapoi.
Preamble.
WHEREAS the land described in the Schedules A and B hereto, being portions of the foreshore of the Waimakariri River, was formerly vested in the Waimakariri Harbour Board: And whereas the said Board has conceded to the Corporation of the Borough of Kaiapoi all its rights to the said lands; and it is expedient that the lands as aforesaid be vested in the Council:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Kaiapoi Borough Corporation Vesting Act, 1893.”
2 Interpretation.
In the construction of this Act,—
“Corporation” means the Mayor, Councillors, and Burgesses of the Borough of Kaiapoi, as constituted under “The Municipal Corporations Act, 1886”:
“Board” means the Waimakariri Harbour Board, as constituted under “The Harbours Act, 1878”:
“Land” means the land described in the Schedules hereto, together with all buildings and erections thereon.
3 Land vested in Council.
On the passing of this Act the lands described in the Schedule hereto shall, without any transfer or conveyance, be vested in the Corporation for an estate in fee-simple, and the District Land Registrar at Christchurch is hereby directed and empowered to make and issue to the Corporation and its successors a certificate of title to the same in accordance with “The Land Transfer Act, 1885.”
SCHEDULES
Schedule A
All that parcel of land situated in the Borough of Kaiapoi, and containing by admeasurement 16 perches, more or less, and upon which stands the Fire Brigade Station. Bounded by a line commencing at a point being the western corner of the junction of Cookson Street with Charles Street, the said point being distant from Standard Stone No. 20, 87 links, measured westerly and in a straight line with a bearing of 261° 40; and proceeding thence south-westerly along the northern side of Cookson Street to the flood-water embankment; thence north-westerly along the flood-water embankment; thence north-easterly along the southern boundary of Lot 6 of the Waimakariri Harbour Board Reserves, to Charles Street; and thence south-easterly along the western boundary of Charles Street to the commencing-point.
Schedule B
All that parcel of land situated in the Borough of Kaiapoi, containing by admeasurement 17 perches, and upon which stands the Morgue. Bounded by a line commencing at a point on the western boundary of Charles Street, the said point being distant northerly from the western corner of the junction of Jones Street with Charles Street 132–6 links, measured along the said street, and proceeding thence south-westerly, and in a straight line with a bearing of 230° 39’ 24”, for a distance of 175 links; thence north-westerly, and in a straight line with a bearing of 320° 39’ 24”; thence north-easterly along the southern boundary of Lot 13 of the Waimakariri Harbour Board Reserves, to Charles Street; thence south-easterly along the western boundary of Charles Street to the commencing-point.
