An Act to authorise the District of Palmerston North Hospital and Charitable Aid Board to construct certain Drainage-works in the Borough of Palmerston North.

Preamble.

WHEREAS, for the purpose of draining the Palmerston North Hospital and the lands attached thereto being under the control of the District of Palmerston North Hospital and Charitable Aid Board (in this Act hereinafter throughout referred to as “the Board”), it is necessary to construct a certain sewer or drain along and under part of a certain public road known as Terrace Street in the Borough of Palmerston North: And whereas it has been agreed between the Board and the Council of the Borough of Palmerston North (in this Act hereinafter throughout referred to as “the Borough Council”) that the Board should construct the said sewer or drain, and that the Borough Council should within the period of eight years from the commencement of this Act repay to the Board the actual cost of the construction of the said sewer or drain: And whereas it is expedient to confer upon the Board and the Borough Council the necessary powers to carry the said agreement into effect:

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

The Short Title of this Act is “The District of Palmerston North Hospital and Charitable Aid Board Empowering Act, 1893.”

2 Board may construct drain, pay cost thereof, and connect any existing sewer therewith.

The Board may forthwith construct a sewer or drain nine inches in diameter along or under that part of the said public road known as Terrace Street aforesaid lying between the most northerly point where the aforesaid street intersects Featherston Street East and the point where the first-mentioned street intersects Main Street, in the said borough; and may connect the said sewer or drain so authorised to be constructed with the existing public sewer or drain running along and under Main Street aforesaid; and may connect any drains hereafter to be constructed in and upon the lands belonging to the said hospital buildings for the purpose of draining such hospital lands and buildings with the sewer or drain hereby authorised to be constructed; and may, for all or any of the purposes hereinbefore authorised, enter into and upon the aforesaid part of Terrace Street, and break up the soil thereof, and excavate trenches therein, and do all such acts, matters, and things as the Board shall judge expedient, necessary, or proper for the purpose of constructing the said sewer or drain: and the Board may pay the cost of the construction of the said drainage-works out of any funds at its disposal.

3 Drain to be constructed under supervision of Council.

The aforesaid sewer or drain so authorised to be constructed shall be constructed in accordance with plans and specifications to be first approved of by an engineer to be appointed by the Borough Council in that behalf, and shall be constructed under the supervision of such engineer.

4 Drain to be a public drain.

The said sewer or drain hereby authorised to be constructed shall, when constructed, be for all purposes a public drain.

5 Borough Council to repay to Board cost of construction of drain.

The Mayor, Councillors, and Burgesses of the Borough of Palmerston North shall, within the period of eight years from the commencement of this Act, repay out of the borough fund to the Board the actual cost of the construction of the said drain or sewer along or under Terrace Street, but without interest or other accretion.
