An Act to amend “The Ocean Beach Public Domain Act, 1892.”
Preamble.
WHEREAS it is desirable to give other and different powers to the Board constituted by “The Ocean Beach Public Domain Act, 1892”
(hereinafter called “the said Act”
), and to amend the said Act:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Ocean Beach Public Domain Act 1892 Amendment Act, 1894.”
2 Board may levy rate in lieu of borrowing.
The Board may, in lieu of borrowing the moneys authorised by the said Act, levy a rate not exceeding one halfpenny in the pound on the rateable value of property in the borough rated.
3 Poll to be taken.
No such rate shall be levied without the consent of the burgesses, in which term is included the citizens of Dunedin, obtained by taking a poll in the manner provided in the said Act for taking a poll for the raising of a loan.
4 Voting-papers.
The voting-papers for taking the said poll shall be printed in the form in the Sixth Schedule to “The Municipal Corporations Act, 1886,”
with such alterations as shall be necessary, and shall be headed “Voting-paper for a Rate for the Ocean Beach Public Domain,”
and shall contain, in two distinct lines, “I vote for the above rate,”
and “I vote against the above rate.”
5 Limit of period for levying rate.
If a majority of the ratepayers who vote are in favour of the said rate, then the Board may proceed to levy the rate from time to time for a period of five years, and no longer, until another poll shall again be taken. All the provisions of the said Act, where applicable for the taking of a poll for the raising of the said loan, and all the provisions of “The Regulation of Local Elections Act, 1876,”
as regards the taking of a poll, shall, so far as applicable, apply to the taking of a poll on the proposal to levy a rate.
6 Saving.
Notwithstanding anything contained in this Act, it shall be lawful for the Board to take a poll under the said Act as to the proposal for raising a loan at the same time as a poll is taken under this Act for the levying of a rate. And both of such polls shall be taken at the same time, and the proposal for which the greater number of votes shall have been given shall be deemed to have been carried.
