An Act to vest in the Waimakariri Harbour Board certain Lands, being Part of the Foreshores in the Borough of Kaiapoi, on the North Branch of the Waimakariri.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Waimakariri Harbour Board Land Act, 1896.”
2 Land vested in Waimakariri Harbour Board.
The parcel of land described in the Schedule hereto shall be and the same is hereby vested in the Waimakariri Harbour Board and its successors for an estate in fee-simple in possession, subject to all the provisions of “The Harbour Boards Act, 1878,”
relating to lands vested in Harbour Boards; and the District Land Registrar at Christchurch shall issue a certificate of title in accordance with the provisions of “The Land Transfer Act, 1885,”
in favour of the said Board and its successors accordingly.
3 Extension of streets to water’s edge.
The Kaiapoi Borough Council may at any time hereafter extend to the water’s edge any streets of the borough now leading into Charles Street or Raven Street, and the land forming any such extension shall be transferred by the Waimakariri Harbour Board to the Corporation of the Kaiapoi Borough without compensation.
4 Right to Sim’s Wharf not affected.
No right, legal or equitable, which any person may now have to the possession or use of the wharf known as Sim’s Wharf, and the sheds adjoining the same, shall be affected by this Act.
5 This Act to be read with “The Harbours Act, 1878.”
This Act shall be read and construed with “The Harbours Act, 1878,”
which said Act is incorporated herewith.
Schedule
All that parcel of land in the Borough of Kaiapoi, in the Land District of Canterbury, being portion of foreshore along the banks of the River Waimakariri, bounded as follows, namely: Towards the north-east by the freehold land now vested in the Waimakariri Harbour Board, being Lots 1 and 2, and being part of the land included in certificate of title, Vol. cxxxvi., folio 58; towards the south-west by high-water mark on the bank of the Waimakariri River; towards the north-west by Cookson Street; and towards the south-east by Jones Street.
Also, all that parcel of land situate in the Borough of Kaiapoi, in the Land District of Canterbury, bounded as follows, namely: Towards the north-east by Charles Street; towards the north-west by Jones Street; towards the southward and east by high-water mark on the bank of the Waimakariri River.
Also, all that parcel of land situate in the Borough of Kaiapoi, in the Land District of Canterbury, bounded as follows, namely: Towards the north-east by Charles Street; towards the east by Commercial Road; and towards the south-west and south-east by high-water mark on the bank of the Waimakariri River.
Also, all that parcel of land situate in the Borough of Kaiapoi, in the Land District of Canterbury, bounded as follows, namely: Towards the south-east by High Street; towards the south-west by Raven Street; towards the north-east by high-water mark on the bank of the Waimakariri River, and by parts of Rural Section 321, the freehold property of William White and of Christ’s College; and towards the north-west by high-water mark on the bank of the River Waimakariri.
Also, all that parcel of land situate in the Borough of Kaiapoi, in the Land District of Canterbury, being Provincial Reserve No. 402, in red, as the same is set out in the Schedule to “The Beswick Wharf Ordinance, 1864,”
