An Act to further amend “The Gisborne Harbour Act, 1884,”
and the Several Amendments thereof.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Gisborne Harbour Board Empowering Act, 1896.”
2 Deemed to be a special Act.
This Act shall be deemed to be a special Act within the meaning of “The Harbours Act, 1878,”
which Act is hereby incorporated in this Act.
3 Interpretation.
In this Act, the expression—
“The Board” means the Gisborne Harbour Board:
“The said Acts” means “The Gisborne Harbour Act, 1884,”
and includes the several amendments thereof respectively.
4 Public Trustee to pay to the Board £15,000.
Notwithstanding anything in the said Acts or in any of them contained to the contrary, it shall be lawful for the Public Trustee, and be is hereby authorised and directed, to pay to the Board out of the unexpended balance of fifty-nine thousand one hundred and sixty-six pounds of loan-money, with the accrued interest thereon, now vested in him under the provisions of the said Acts, the sum of fifteen thousand pounds: Provided that the said sum of fifteen thousand pounds shall be deemed to be in addition to the sum of forty thousand pounds provision for which is made in clause five of “The Gisborne Harbour Board Act 1884 Amendment Act, 1887,”
and that charges for interest and sinking fund thereon shall be chargeable as therein provided against the special district constituted under that Act.
5 Authorising Board to expend £10,000.
It shall be lawful, and the Board is hereby authorised and empowered, subject to the previous approval by the Governor of the works proposed to be constructed, to expend the sum of ten thousand pounds, part of the said sum of fifteen thousand pounds, in repairing and keeping in proper repair the harbour-works already constructed by the Board under the provisions of the said Acts.
6 Authorising expenditure of £5,000 by the Board.
It shall be lawful, and the Board is hereby further empowered and authorised, to expend the balance of the said sum of fifteen thousand pounds—namely, the sum of five thousand pounds—in repairing and extending towards the sea the western groin of the said works heretofore duly authorised to be constructed.
7 £15,000 to be paid by Public Trustee in such amounts as required.
The said sum of fifteen thousand pounds shall be paid by the Public Trustee to the Board in such amounts as the Board may from time to time require.
