AN ACT to empower the Bluff Harbour Board to sell Sections 4 and 5 of Block XII. in the Town of Campbelltown, and to apply the Net Proceeds thereof in the Purchase of other Land for an Endowment for the Board.

Preamble.

WHEREAS the land described in the Schedule is vested in the Bluff Harbour Board (constituted under “The Harbours Act, 1878,” and hereinafter referred to as “the Board”) for the purpose of offices for the use of the Board: And whereas the said land is unsuitable for such purpose, and it is desirable to empower the Board to sell the same, and to apply the net proceeds thereof in the purchase of other land, to be held as an endowment for the Board:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

The Short Title of this Act is “The Bluff Harbour Board Empowering Act, 1897.”

2 Bluff Harbour Board may sell land described in Schedule.

The Board may sell the land described in the Schedule, either by public auction or by private contract, and either in one lot or in several lots, at such price or prices and upon such terms and conditions as it shall think fit, and may execute all necessary or requisite instruments for conveying, assuring, and transferring the same to the purchaser or respective purchasers thereof, and for discharging him or them from payment of the purchase-money payable by him or them.

3 Application of proceeds.

After payment of all costs, charges, and expenses of and incidental to such sale or sales, the net proceeds of such land shall be paid and applied by the Board in the purchase of other land, which shall be held by the Board in trust as an endowment for the Board, and may be dealt with by the Board in the manner prescribed by “The Harbours Act, 1878,” as to lands vested in it.

Schedule

All that parcel of land in the Southland Land District, situated in the Town of Campbelltown, containing by admeasurement 2 roods 4 perches, more or less, being Sections Nos. 4 and 5, Block XII., of the said town. Bounded towards the north by Sections Nos. 1, 6, and 3 of said block, 268 links; towards the south-east by Section No. 7, Block I., Campbelltown Hundred, 276 links; towards the south by Foyle Street, 151 links; and towards the west by Lee Street, 250 links: be all the aforesaid linkages more or less.
