An Act to authorise a Grant of Land, being Portion of Mahoenui D Block, to Joseph Houston, of Waitara.
Preamble.
WHEREAS by certificate of title, Volume Seventy-four, folio one hundred and seventy-seven, of the Land Transfer Register of the Auckland District, dated the tenth day of April, one thousand eight hundred and ninety-five, the block of land known as or called “Mahoenui,”
containing eight thousand and thirty-six acres, more or less (hereinafter called “the said block”
), was certified to be the property in fee-simple of Arapata Rangituataka and forty-three other aboriginal natives of New Zealand therein mentioned (hereinafter called “the Native owners”
):
And whereas by certain memoranda of lease and transfer, duly registered on the said certificate of title, Joseph Houston, of Waitara, settler, became the registered proprietor of a lease for twenty-one years from the twenty-seventh day of December, one thousand eight hundred and ninety-three, of the whole of the said block with the exception of five hundred acres, being Subdivision E, as hereinafter specified:
And whereas the Native Land Court, sitting at Otorohanga on the nineteenth day of April, one thousand eight hundred and ninety-five, made partition amongst the Native owners of the said block, under the provisions of “The Native Land Court Act, 1894,”
and for the purposes of such partition subdivided the land into the subdivisions specified in the First Schedule hereto:
And whereas Her Majesty the Queen has acquired for an estate of freehold in fee-simple Subdivisions B, C, and D, as the same are specified in the First Schedule hereto, and has also acquired certain freehold interests in Subdivisions A and E, as the same are specified in the same Schedule, and is in negotiation for the acquisition of further interests therein, subject in each case to the said lease:
And whereas the said Joseph Houston has contracted with the Minister of Lands for the surrender of the said lease, in respect only of Subdivisions B, C, and D, in exchange for. a freehold title to a portion of Subdivision D, containing two thousand acres, more or less, as the same is specified in the Second Schedule hereto:
BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Joseph Houston Land-grant Act, 1897.”
2 Land in Second Schedule granted to Joseph Houston for an estate in fee-simple, upon certain conditions.
On due compliance with the following conditions, that is to say,—
(1.)
The payment at any time within twelve months from the passing of this Act by the said Joseph Houston to the Receiver of Land Revenue at Auckland of such sum as the Minister of Lands certifies in writing to be the cost price, including incidental expenses, of the land described in the Second Schedule hereto; and also,
(2.)
The production to the District Land Registrar at Auckland of a certificate under the hand of the said Receiver that such payment has been duly made; and also,
(3.)
The surrender by the said Joseph Houston, and of every person deriving any estate or interest through or from him, of the said lease in respect of Subdivisions B, C, and D of the said block, freed and discharged from all encumbrances, liens, and interests whatsoever,—
the said Registrar shall, without further authority than this Act, issue a certificate of title to the said Joseph Houston as the proprietor of an estate in fee-simple in the land described in the Second Schedule hereto.

SECOND SCHEDULE Portion of Subdivision D of Mahoenui Block to be granted to Joseph Houston
ALL that parcel of land in the Auckland Land District, situated in Awakino East Survey District, being portion of a block called or known by the name of Mahoenui D, and containing by admeasurement 2,000 acres, more or less. Bounded towards the north-west and north-east by the Ngatarawa Stream and by Mahoenui No. 2 Block, 2558 links and 7610 links; towards the south-east by Manga Awakino No. 4 Block, 4500 links, 132 links, 554 links, and 10689 links; towards the south-west by other portion of Mahoenui D Block and by Mahoenui E Block, 11879 links and 7940 links; and again towards the north-west and north-east by the Awakino River: be all the aforesaid linkages more or less: as the same is delineated on the plan numbered 6323fd, deposited in the Survey Office, Auckland.
