An Act to vest in the Johnsonville Town Board Land set aside for the Purposes of a Public School.
Preamble.
WHEREAS by deed bearing date the second day of February, one thousand eight hundred and sixty-five, registered in the District Registry Office at Wellington, number 4917, and expressed to be made between William Reeves of the one part and Henry Taylor and Robert Bould of the other part, all that parcel of land described in the Schedule to this Act was conveyed and assured by the said William Reeves to the said Henry Taylor and Robert Bould: And whereas by a declaration indorsed upon the said conveyance the said Henry Taylor and Robert Bould declared that the said parcel of land was held by them upon trust for the purposes of the common school at Johnsonville, subject to all laws and regulations relating to such schools in the Provincial District of Wellington: And whereas by an order of the Supreme Court of New Zealand made on Tuesday, the twentieth day of November, one thousand eight hundred and eighty-eight, it was ordered that Robert Bould, son of the said Robert Bould, who had lately died, Frank Albert Orbell, and Justinian Powell should be the trustees for the purposes aforesaid: And whereas since the date of the said order the said Frank Albert Orbell has died, and the said Robert Bould and Justinian Powell are desirous of retiring from the said trust, and it is expedient that the said land should be vested in the local body having authority in Johnsonville aforesaid:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Johnsonville School Reserve Act, 1898.”
2 Land to vest in Town Board.
The parcel of land described in the Schedule to this Act, hereinafter referred to as “the said reserve,”
is hereby vested in the Johnsonville Town Board and its successors for the purposes of the common school at Johnsonville, subject to all laws and regulations relating to such schools in the Provincial District of Wellington; and the District Land Registrar at Wellington is hereby authorised and directed to issue a certificate of title in accordance with this provision.
3 Authority to make by-laws.
The Johnsonville Town Board or other the local authority for the time being of Johnsonville is hereby authorised to make by-laws and regulations for the management of the said reserve.
4 Power to lease the reserve.
The said local authority is empowered from time to time to lease and demise or otherwise deal with the said reserve or any part thereof in manner prescribed by “The Public Bodies’ Powers Act, 1887.”
Schedule
All that piece of land, containing half an acre, being part of Section No. 12 on the plan of the Porirua District, in the Provincial District of Wellington. Bounded towards the west generally by the Porirua Road from a point distant 70 links from the south-western corner of the part of the said section granted to William Reeves by grant registered in the Deeds Registration Office, Wellington, numbered 4015, 100 links; towards the north generally by a line parallel to the southernmost boundary-line of the said grant, 500 links; towards the east generally by a line parallel to the Porirua Road, 100 links; and towards the south generally by a line parallel to the southernmost boundary-line of the said grant, 500 links.
