An Act to enable the New Zealand Wesleyan Methodist Church to acquire a Site for a Church in the Village Settlement of Nukuroa, in the School District of Hannaton, County of Waimate.
Preamble.
WHEREAS lot numbered 3 of reserve numbered 1128, part of Nukuroa Village, Land District of Canterbury, is held on perpetual lease under village-settlement conditions: And whereas the New Zealand Wesleyan Methodist Church is desirous of obtaining a small portion of such land as a site for a church, and the lessee is desirous of setting apart a quarter of an acre of land for that purpose, but there is no power to enable this to be done:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Hannaton Church Site Act, 1898.”
2 Land Board may accept surrender.
The Canterbury Land Board may, on application to that effect by the lessee, accept a surrender of any portion of such land not exceeding one-quarter of an acre.
3 Registration of surrender.
Upon such surrender being accepted, a note thereof shall be indorsed by the Commissioner of Crown Lands at Christchurch upon the instrument of lease, and upon the copy of same in the office of the District Land Registrar, and the Registrar shall thereupon, without fee, register the surrender.
4 Sale of fee-simple of surrendered land.
The fee-simple of the land so surrendered may be sold by the Commissioner for cash to the New Zealand Wesleyan Methodist Church as a site for a church, at a price to be fixed by the Board, without requiring any declaration or formal application, and without submitting the land to auction as required by “The Land Act, 1892.”
