An Act to constitute the Mount Herbert County.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Mount Herbert County Act, 1902.”
2 Mount Herbert County constituted.
The Mount Herbert County is hereby constituted, and shall comprise that portion of the Akaroa County particularly described in the Schedule hereto, and the boundaries of the Akaroa County are hereby altered accordingly.
3 Road districts abolished.
The Port Levy and Port Victoria Road Districts are hereby abolished, and shall be deemed to be merged in the Mount Herbert County constituted by this Act, and the provisions of section fifty- seven of “The Counties Act, 1886,”
shall apply thereto accordingly.
4 Jurisdiction of County Council
From and after the coming into operation of this Act, and during the existence of the county hereby constituted, no local body or authority other than the County Council shall, within the limits of the said county, exercise any jurisdiction or authority over any roads, or over or in relation to any matter or thing in respect of which jurisdiction is conferred upon a County Council under the provisions of “The Counties Act, 1886,”
or any amendments thereof, or otherwise.
Schedule
All that area in the Canterbury Land District, comprising the Port Levy and Port Victoria Road Districts, bounded towards the south-east generally by the Pigeon Bay Road District as described in special order of Akaroa County Council, published in the New Zealand Gazette No. 70, 13th June, 1884, from Big Bay to the Summit Road; thence by the Summit Road to its junction with the Port Levy and Little River Road; thence towards the south-west generally by the Summit Road to its junction with the Mount Herbert Peak Road; and thence by the Mount Herbert Peak Road to a point in line with a right line drawn between Mount Herbert and Herbert Peak, thence by a right line to Mount Herbert; thence by a right line through Trig. Station L1 to the summit of the Port Hills; thence towards the west and north-west by the summit of the said Port Hills to the north- eastern boundary of Native Reserve (Raupaki) at the western boundary of the Borough of Lyttelton; thence towards the north-east by the western boundary-line of that borough in a south-easterly direction to the sea; thence by a right line to Church Bay; and thence towards the north generally by the sea to the starting- point at Big Bay.
