An Act to vest in the Mayor, Councillors, and Burgesses of the Borough of Lower Hutt a certain Parcel of Land in the said Borough, and to empower the said Mayor, Councillors, and Burgesses to sell the said Land upon such Terms and Conditions as they shall think fit, and to apply the Proceeds of such Sale in the Purchase of Books, Scientific Apparatus, Works of Nature or Art.
Preamble.
WHEREAS the parcel of land described in the Schedule hereto is vested in the Trustees for the time being of the Hutt Mechanics’ Institute upon trust for the purposes of such Institute: And whereas the present Trustees of such Institute are desirous that the Lower Hutt Borough Council should assume control of such Institute and acquire the property thereof: And whereas the Lower Hutt Borough Council are providing the necessary accommodation for such Institute in the buildings now being erected or about to be erected for such Council, and will not therefore require to use such land as a site for the Hutt Mechanics’ Institute: And whereas the present Trustees of the said Institute are desirous that such land should be transferred to the Council and then sold by the Council, and the proceeds applied by such Council as hereinafter provided:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Hutt Mechanics’ Institute Sale Act, 1903.”
2 Interpretation.
In this Act, if not inconsistent with the context,—
“Corporation” means the Mayor, Councillors, and Burgesses of the Borough of Lower Hutt as constituted under “The Municipal Corporations Act, 1900,”
as a borough incorporated before and existing at the time of the commencement of the said Act:
“The said land” means the land described in the Schedule hereto.
3 Land to vest in Corporation.
From and after the passing of this Act the estate in fee-simple in possession of the said land shall by virtue of this Act be vested, without any conveyance or transfer, in the Corporation, subject only to the trusts hereinafter provided.
4 Power given to Corporation to sell and execute conveyances.
The Corporation is hereby authorised—
(a.)
To sell the said land either together or in parcels, and either by public auction or public tender, for such price and upon such terms and conditions as to the Corporation shall seem best;
(b.)
To execute under the seal of the Corporation the necessary conveyance and assurance of the said land or any part thereof to the purchaser or purchasers thereof.
5 Application of purchase-money.
All purchase-moneys received by the Corporation for the sale of the said land shall be applied in the purchase of books, scientific apparatus, works of nature or art.
Schedule
All that area in the Wellington Land District, containing by admeasurement 13 perches, more or less, being part of Section No. 28, Lower Hutt District (Belmont Survey District): bounded by a line commencing at a point on the north side of the main Hutt Road, 292·49 links south and 525·34 links west of Government Standard Block No. VIII., and proceeding thence in a south-westerly direction along the north side of the main Hutt Road for a distance of 136·5 links; thence north-westerly, bearing N. 36° 59’ W., for a distance of 61·13 links; thence north-easterly, bearing N. 53° 13’ E., for a distance of 136 5 links; and thence south-easterly, bearing S. 36°59’E., to the point of commencement: being all the land comprised in the Crown grant dated the 17th day of August, 1858, registered in the Deeds Registry Office at Wellington as No. 8180.
