An Act to authorise the Otago Dock Trust to contract with His Majesty the King, or with any other Person or Persons or Body Corporate, for the Construction and Maintenance and Working of an Electric Installation at Port Chalmers for lighting the Wharves and Docks, and for other Private and Public Purposes in the Borough of Port Chalmers.
Preamble.
WHEREAS it is expedient that power should be given to the Otago Dock Trust to contract for the supply of electrical energy for the lighting of the wharves and docks, and for other public and private purposes, at Port Chalmers:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Otago Dock Trust Electric Lighting Act, 1903.”
2 Interpretation.
In this Act, if not inconsistent with the context hereof, and unless there are words to exclude or restrain such meaning, the words and expressions following shall severally have the meanings hereinafter assigned to them, that is to say,—
“Electricity” means electricity, electric current, or any like agency:
“Energy” means electrical energy; and for the purpose of this Act electrical energy shall be deemed to be an agency within the meaning of “electricity”
as defined by this Act:
“Person” means any person, company, local authority, or body corporate:
“Private purpose” refers to any purpose whatever to which electricity may for the time being be applied, not being public purpose, but shall not include the transmission of any telegram:
“Public purpose” refers to the supply of electricity to or in any wharf, pier, dock, street, or building belonging to or subject to the control of the Crown, or of the Trust, or of any local authority, but shall not include any other purpose to which electricity may be applied:
“Trust” means the Otago Dock Trust:
“Works” means and includes electric lines; also any buildings, machinery, engines, works, matters, or things, of whatsoever description, required to generate or supply electricity and to carry into effect the objects of this Act.
3 Power to erect works for supplying electrical energy.
Subject and without prejudice to “The Electric Lines Act, 1884,”
and “The Municipal Corporations Act, 1900,”
the Trust may construct, maintain, and carry on an electric installation and works for supplying electrical energy within the Borough of Port Chalmers, and to the wharves and docks therein and adjacent thereto, and may contract with His Majesty the King or with any person for the supply of electrical energy for any public or private purpose, upon such terms and conditions, for such period, and subject to such regulations and provisions as may be agreed upon between the contracting parties; and shall for such purpose have power, with the consent and subject to the control of the Council of the Borough of Port Chalmers, but not otherwise, to break up or cross over streets, and place mains, service-lines, and wires either above or below ground and over or under streets and roads, and lay down and place pipes, conduits, and service-pipes, and erect pillars, arches, and poles, in and upon the streets, roads, and other places, and make, construct, and do other works and things for supplying energy within such area of supply or any part thereof, upon such terms and conditions and subject to such regulations and provisions as may be agreed upon between the contracting parties.
