An Act to empower the Mayor, Councillors, and Burgesses of the Borough of Whangarei to repay to the Ratepayers of the said Borough all Moneys collected from them by way of Separate Rate for the Purpose of purchasing certain Property in the Borough of Whangarei known as the “Kensington Park.”
Preamble.
WHEREAS the Mayor, Councillors, and Burgesses of the Borough of Whangarei did by special order of the fourteenth day of March, one thousand nine hundred and one, and made in pursuance of sections ninety-eight and ninety nine of “The Municipal Corporations Act, 1900,”
make and levy within the said Borough of Whangarei a separate rate of three farthings in the pound on all rateable property, such rate to be an annually recurring rate for two years, for the purpose of purchasing, in conjunction with the Crown, certain lands within the said borough known as the “Kensington Park,”
and being parts of Allotments One and Two of the Parish of Whangarei and County of Marsden: And whereas the said rates have been duly collected: And whereas the object for which the said separate rate was made and levied has not been, and cannot be, carried into effect: And whereas it is expedient that the rates collected as aforesaid should be returned to the ratepayers paying the same, and for that purpose it is necessary that special legislation should be passed to enable this to be done:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Whangarei Borough Repayment of Kensington Park Rate Enabling Act, 1903.”
2 Whangarei Borough Council may refund rates collected for purpose of purchasing Kensington Park.
It shall be lawful after the passing of this Act for the Mayor, Councillors, and Burgesses of the Borough of Whangarei to pay and refund to the ratepayers of the said borough, or their legal representatives, all rates levied and collected from the said ratepayers in pursuance of a special order of the fourteenth day of March, one thousand nine hundred and one, made by the said Mayor, Councillors, and Burgesses of the Borough of Whangarei for the purpose of purchasing, in conjunction with the Crown, certain lands within the said borough known as the “Kensington Park,”
and being parts of Allotments One and Two of the Parish of Whangarei and County of Marsden.
