An Act to remove Doubts as to certain Proceedings of the Council of the County of Ohinemuri in relation to the Raising of a Loan of One Thousand Seven Hundred and Fifty Pounds for the Purpose of acquiring, laying-out, fencing, forming, and planting a Public Recreation-ground and Public Domain at Paeroa, in the County of Ohinemuri.
Preamble.
WHEREAS the Council of the County of Ohinemuri, in accordance with a resolution of the ratepayers passed at a public meeting held at Paeroa, in the County of Ohinemuri, on the twelfth day of November, one thousand nine hundred and three, took the requisite steps for a poll of such ratepayers under the provisions of “The Local Bodies’ Loans Act, 1901,”
on a proposal to acquire, lay out, fence, form, and plant a public recreation-ground and public domain at Paeroa (including the necessary buildings and erections, and the purchase of additional lands if required, and the payment of the preliminary expenses in connection with the scheme), and at such poll on the twenty-sixth day of November, one thousand nine hundred and three, the said proposal was carried, and the result thereof was duly published in accordance with law, and gazetted in the New Zealand Gazette of the third day of December, one thousand nine hundred and three, page 2510: And whereas the said Council of the County of Ohinemuri, by special order of the fifth day of February, one thousand nine hundred and four, created the defined portion of the County of Ohinemuri benefited by such loan into a special-rating district under the provisions of “The Counties Act, 1886,”
to be called or known as “the Paeroa Improvement Special-rating District,”
and under the provisions of “The Local Bodies’ Loans Act, 1901,”
made and levied a special rate of one penny in the pound upon the rateable value of all rateable property within the said Paeroa Improvement Special-rating District for the purpose of providing the interest and other charges upon the said loan of one thousand seven hundred and fifty pounds; and public notification of the special order making and levying such special rate was published in the New Zealand Gazette of the nineteenth day of May, one thousand nine hundred and four, page 1319: And whereas the said loan was duly raised by the said Council of the County of Ohinemuri: And whereas by Orders in Council made on the twenty-first day of June, one thousand nine hundred and two, and published in the New Zealand Gazette of the twenty-seventh day of June, one thousand nine hundred and two, page 1347, the Paeroa Recreation-ground was brought under “The Public Domains Act, 1881,”
and the powers of His Excellency the Governor were delegated to the Ohinemuri County Council as “the Paeroa Domain Board,”
and the Council as such Board has expended the sum of one thousand pounds out of the said loan upon the works mentioned in the said proposal: And whereas doubts have arisen as to the validity of the actions of the said Council and as to the power of the said Council to raise the said loan for the purposes aforesaid, and it is expedient to remove such doubts and to validate the said loan and the aforesaid matters in connection therewith:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Paeroa Domain Loan Validation Act, 1905.”
2 Validating loan for Paeroa Domain and Recreation-ground.
All the above-recited proceedings of the Council of the County of Ohinemuri respecting the taking of the said poll, the making and levying of the said special rate, and the raising of the said loan of one thousand seven hundred and fifty pounds, and all payments by the Ohinemuri County Council to the Paeroa Domain Board out of such loan, are hereby validated, and the said loan shall be deemed to be a loan duly raised under the provisions of “The Local Bodies’ Loans Act, 1901”
; and the Council of the County of Ohinemuri is hereby authorised to pay over to the Paeroa Domain Board the unexpended balance of the said loan, to be expended by the Paeroa Domain Board on the works and for the purposes for which the said loan was raised.
