An Act to authorise the Otago Dock Trust to borrow Moneys for the Erection of an Abattoir, and to make other Provisions in relation to the said Trust.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Otago Dock Acts Amendment Act, 1906”
; and it shall be read together with “The Otago Dock Act, 1883,”
“The Otago Dock Act 1883 Amendment Act, 1885,”
and “The Otago Dock Act Amendment Act, 1895.”
2 Power to purchase or lease lands and erect abattoir.
The Otago Dock Trust and its successors (hereinafter called “the Trust”
) may, in addition to all other powers it possesses, do the following things:—
(a.)
Acquire by purchase or by lease, upon such terms as may be agreed upon, a parcel or parcels of land of sufficient area, and thereon erect, equip, establish, and maintain an abattoir, provide paddocks for the accommodation of stock, provide plant for dealing with offal and other by-products, and carry on the business of an abattoir and slaughterhouse, for the purposes of the slaughter of stock for the export of meat beyond the colony and for the purposes of the Borough of Port Chalmers and the surrounding districts, and for the disposal of the offal and by-products; the Trust shall be entitled to demand, recover, and receive such fees and charges in connection therewith as it may from time to time consider proper:
(b.)
Lease an abattoir for the above purposes, upon such terms as may be agreed upon, from any person or persons or body corporate:
(c.)
Enlarge to the extent it may consider necessary the Trust’s cool-stores at Port Chalmers, and provide necessary machinery and appliances for working the same when so enlarged as aforesaid:
(d.)
Sell the said abattoir so erected as aforesaid, and the lands appertaining thereto, or let the same on lease at such annual rental and upon such terms as may be agreed upon from time to time for any term not exceeding fourteen years:
Provided that every such sale or lease shall be by public auction or public tender of which at least fourteen days’ notice shall be publicly notified:
Provided also that in the event of the sale of the said abattoir and lands the proceeds of such sale shall be devoted to the payment of the moneys hereinafter authorised to be borrowed.
3 Power to borrow.
In order to raise money for the purchase of the said lands and the erection of the said abattoir, and to enable the Trust to exercise the other powers by this Act conferred upon it, the Trust may from time to time borrow, in addition to all other moneys borrowed or raised or authorised to be borrowed and raised by the Trust, a sum or sums of money not exceeding in the whole five thousand pounds; but no money shall be borrowed under the authority of this Act which shall produce to the lender a higher rate of interest than five pounds per centum per annum.
4 Abattoir within the meaning of the Act.
The abattoir erected or acquired by the Trust under the powers hereinbefore contained shall be deemed to be an abattoir and meat-export slaughterhouse within the meaning of “The Slaughtering and Inspection Act, 1900.”
5 Council may delegate power to erect abattoir.
Notwithstanding anything contained in subsection one of section fifteen of “The Slaughtering and Inspection Act, 1900,”
the Council of the Borough of Port Chalmers may, in lieu of itself establishing an abattoir, delegate to the Trust the power to establish an abattoir, upon such terms and conditions as, with the previous approval of the Minister for Agriculture, are agreed upon. In such cases all the rights, powers, functions, and duties by the said Act conferred and imposed upon the delegating authority (except the power to raise a special loan or use the funds of the said local authority) shall accordingly to the tenor of the delegation devolve upon the Trust as fully as if it were the controlling authority.
6 Money to be paid into separate account.
All moneys received by the Trust by virtue of clause three of this Act shall be paid to a separate account, and all payments made for the purpose of this Act shall be paid out of the said account.
7 Act deemed a special Act.
This Act shall be deemed a special Act within the meaning of section one hundred and eighty-eight of “The Harbours Act, 1878,”
in like manner and as fully as if the Trust were a Harbour Board.
