An Act to vest certain Streets situated in the Borough of Gladstone in the Mayor, Councillors, and Burgesses of the said Borough, and to validate the Closing of one of the said Streets.
Preamble.
WHEREAS in the year one thousand eight hundred and seventy-eight certain land now in the Borough of Gladstone was laid off as a township, and is known by the name of Burton, and a plan of the said township was deposited in the Lands Registry Office at Invercargill on the first day of April, one thousand eight hundred and seventy-eight, and is numbered nineteen: And whereas in the year one thousand eight hundred and eighty-two certain other land in the said Borough of Gladstone was laid off as a township, and is known by the name of Coldstream, and a plan of the said township was deposited in the said Lands Registry Office on the nineteenth day of April, one thousand eight hundred and eighty-two, and is numbered one hundred and eight: And whereas certain streets are shown on the said plans, but such streets have never been dedicated as public streets, although many of the sections in the said townships have been sold and occupied: And whereas it was believed that the said streets had been so dedicated, and the same had been used and regarded and are to all intents and purposes public streets, and the Council of the said borough had with the consent of those concerned taken all the necessary and proper steps to close one of the said streets, known as Bircham Street, before the fact of non-dedication was ascertained: And whereas it is desirable to vest the said streets in the Mayor, Councillors, and Burgesses of the said borough as public streets, and to validate and ratify all the steps already taken for closing the said Bircham Street:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Gladstone Streets Vesting and Empowering Act, 1906.”
2 Interpretation.
In the construction of this Act—
“The Corporation” means the Mayor, Councillors, and Burgesses of the Borough of Gladstone, incorporated under “The Municipal Corporations Act, 1900”:
“The Council” means the Council of the said Borough of Gladstone.
3 Streets described in the First Schedule vested in the Corporation of Gladstone.
On and after the passing of this Act the streets and the soil thereof in the Borough of Gladstone named and described in the First Schedule hereto shall be and be deemed to have been vested in fee-simple in the Corporation, as public streets, as from the first day of January, one thousand eight hundred and eighty-seven; and the Council shall have all the powers in respect of the said streets as are conferred upon Councils by “The Municipal Corporations Act, 1900,”
or any Act or Acts amending or extending the said Act.
4 Validating closing of Bircham Street, described in the Second Schedule.
The various steps and proceedings heretofore taken by the Council to close or stop the said street known as Bircham Street, described in the Second Schedule hereto, are hereby validated; and the decision of the electors of the said borough, and of the Stipendiary Magistrate at Invercargill confirming the decision of the said electors, that the said street should be stopped, and the public notice of the Council declaring the same to be stopped, are hereby validated, and the said street shall be and be deemed to have been stopped as from the date of the decision of the said Stipendiary Magistrate namely, the seventh day of April, one thousand nine hundred and five.

FIRST SCHEDULE
The following streets, as shown on the plan of the said Township of Coldstream, deposited in the Lands Registry Office at Invercargill as No. 108:—
1.
Oxenrig Street, 100 links wide: bounded on the east by Ellis Road, and on the west by the western boundary of the said township.
2.
Hirsel Street, 100 links wide: bounded on the east by Ellis Road, and on the west by the western boundary of the said township.
3.
Simprin Street, 100 links wide: bounded on the north by the northern boundary of the said township, and on the south by Hirsel Street aforesaid.
4.
Swinton Street, 100 links wide: bounded on the north by the northern boundary of the said township, and on the south by Hirsel Street aforesaid.
5.
Ramrig Street, 100 links wide: bounded on the north by the northern boundary of the said township, and on the south by Hirsel Street aforesaid.
6.
Lees Street, 100 links wide: bounded on the north by the northery boundary of the said township, and on the south by Hirsel Street aforesaid.
7.
Bircham Street: bounded on the north by the northern boundary of the said township, 141.4 links, and on the south by Hirsel Street aforesaid, 180 links.
The following streets, as shown on the plan of the said Township of Burton, deposited in the Lands Registry Office at Invercargill as No. 19:—
1.
Philip Street, to the east and west of Kingston-Invercargill Railway line: bounded on the north by Shirley Terrace, and on the south by the southern boundary of the said township.
2.
Filleul Street, 100 links wide: bounded on the east by the Main North Road, and on the west by Philip Street aforesaid.
3.
Hensley Street, 100 links wide: bounded on the east by the Main North Road, and on the west by Philip Street aforesaid
4.
Fulton Street, 100 links wide: bounded on the east by the Main North Road, and on the west by Philip Street aforesaid.
5.
Ann Street, 100 links wide: bounded on the north by Filleul Street aforesaid, and on the south by Fulton Street aforesaid.
SECOND SCHEDULE
The said street named Bircham, as shown on the plan of the said Town of Coldstream, deposited in the Lands Registry Office at Invercargill as No. 108: except those parts of the said street where the same is intersected by Oxenrig Street. Simprin Street, and Swinton Street, as shown on the said plan.
