An Act to validate the Construction of a Graving-dock by the Otago Dock Trust.
Preamble.
WHEREAS by “The Otago Dock Act, 1883”
(hereinafter called “the said Act”
), the Otago Harbour Board was enabled to construct at Port Chalmers a graving-dock of sufficient dimensions at least to admit vessels drawing twenty-five feet of water, with power to borrow money for the purpose; but the said Act contains no other provisions as to the dimensions of the said dock: And whereas by “The Otago Dock Act 1883 Amendment Act, 1885,”
the Otago Dock Trust was duly constituted, and all the powers and authority conferred by the said Act upon the said Otago Harbour Board in relation to the construction of a graving-dock at Port Chalmers and of borrowing money for the purpose were transferred to the Otago Dock Trust: And whereas the Otago Dock Trust, in pursuance of the powers and authority so conferred upon it, has borrowed the sum of seventy-five thousand pounds, and has entered into a contract for the construction of a graving-dock at Port Chalmers of the following dimensions: length on floor, five hundred feet; entrance width at coping-level, seventy feet; width inside dock at coping-level, ninety feet; width inside dock at bilge-level, sixty-seven feet; depth of dock on invert, twenty-seven feet; depth of dock on floor, thirty feet; depth of water on invert at high water (mean ordinary spring tides), twenty-two feet: And whereas the said graving-dock is now in course of construction: And whereas doubts have arisen as to the meaning of section four of the said Act and of the expression “a graving-dock of sufficient dimensions at least to admit vessels drawing twenty-five feet of water”
therein, and it has been suggested that the dimensions of the said graving-dock now in course of construction do not comply with the provisions of the said section: And whereas it is desirable to remove such doubts:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Otago Dock Validation Act, 1906.”
2 Interpretation.
It is hereby declared that the said graving-dock now in course of construction at Port Chalmers aforesaid does comply and shall for all purposes be deemed to comply with the provisions of the said section four of the said Act, and the said section shall be construed and given effect to accordingly.
3 Validation of certain acts.
All contracts, deeds of covenant, and agreements made and entered into between the Otago Dock Trust and any person or persons or body corporate for or in relation to the construction of the said graving-dock, or for any payment or payments towards the interest on the money borrowed for the construction of the said dock, and towards the sinking fund for the repayment for the said moneys, and all things done thereunder, shall be deemed to be and from the respective dates thereof to have been valid and effectual and as binding on all parties thereto respectively as if the dimensions hereinbefore mentioned of the said dock now being constructed had been fully set forth and contained in the said section four of the said Act.
