An Act to extend the Provisions of the Local Bodies’ Loans Act, 1901, in so far as the same apply to the City of Wellington, and to enable the Wellington City Council to make and levy Rates to secure Special Loans raised for the Purpose of paying off Loans.
Preamble.
WHEREAS the Council of the City of Wellington has raised the sum of one hundred and sixty-five thousand pounds authorised to be raised by the Wellington City Sanitation Loan Empowering Act, 1892, and the sum of thirty-three thousand pounds authorised to be raised by the Wellington City Sanitation Loan Act, 1897, for providing a scheme of drainage for the Wellington City Drainage Area, being the City of Wellington as it was constituted prior to its amalgamation with the Borough of Melrose and those parts of the late Borough of Melrose and of the Borough of Karori defined in the First Schedule to the Wellington (City) Suburbs Sanitation Act, 1893: And whereas it is now necessary to raise the sum of thirty-three thousand pounds to pay off the said loan of thirty-three thousand pounds, and to secure the same by special rate on the said drainage area: And whereas it will be necessary to raise moneys to pay off the said sum of one hundred and sixty-five thousand pounds: And whereas it will also be necessary from time to time to raise moneys for paying off loans to be raised by special order in connection with or in continuance of said loans: And whereas doubts have arisen as to the power of the Wellington City Council to raise loans in connection with or in continuance of the said loans, and to levy special rates over the part of the Borough of Karori comprised in the said drainage area for the purpose of securing interest and sinking fund on loans raised for such purposes, although it was intended that such rates should be so levied: And whereas the same difficulties may arise in respect of other loans
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Wellington City Empowering Act, 1907.
2 Extension of powers of Wellington City Council to levy special rates in certain cases.
Where the Wellington City Council has heretofore raised or shall hereafter raise any loan for the repayment of any loan repayable by the Mayor, Councillors, and Citizens of the City of Wellington, the rating-powers of the said Council in respect of such repayment loan shall extend, and the rate to be made and levied in respect of such repayment loan may be made and levied, over the same area as that over which the rate leviable in respect of the loan paid off was or could have been made and levied, and any rate heretofore so made and levied is hereby validated.
