An Act to enable the Roman Catholic Bishop of Auckland to sell, mortgage, exchange, and lease certain Lands in the Roman Catholic Diocese of Auckland, Particulars whereof are set out in the Schedule hereto.

Preamble.

WHEREAS the said lands are now vested in the Roman Catholic Bishop of Auckland and his successors, in trust for the purposes of the Roman Catholic Church: And whereas the only power vested in the said Bishop in respect of the said lands is a power to lease the same for a period not exceeding forty-two years: And whereas for the more satisfactory management of the affairs of the said diocese it has been deemed advisable to extend the power of the said Bishop in respect of the said lands in manner hereinafter provided: And whereas the extension of the said power is not attainable otherwise than by legislation:

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

This Act may be cited as the Roman Catholic Bishop of Auckland Special Powers Act, 1909.

2 Interpretation.

In the interpretation of this Act the expression “the Bishop” shall be deemed to mean and include the Roman Catholic Bishop of Auckland for the time being; and the term “the said lands” shall be deemed to be, mean, and include the lands set out in the Schedule hereto, or any part or parts thereof.

3 Roman Catholic Bishop may sell, mortgage, exchange, and lease.

From and after the passing of this Act it shall be lawful for the Bishop to sell and dispose of the said lands by public auction or private contract, with full power to buy in or rescind or vary any contract for sale, and to raise money by way of mortgage on the security of the said lands, and to exchange the said lands for any other lands within the Roman Catholic Diocese of Auckland; and to demise and lease the said lands for any period not exceeding sixty-six years, upon such terms as the Bishop may determine, and to accept the surrender of any leases granted by him: no fine, premium, or foregift to be taken.

4 How lands received in exchange to vest, and moneys derived from sale, mortgage, or lease to be expended.

The lands received by way of exchange shall be situate in the parish or district within which the lands exchanged are situate, and shall vest in the Bishop, subject to the powers given by this Act in respect of the lands exchanged; and the moneys arising from any sale or mortgage, and the rents to be derived from any lease, shall be expended for the purposes of the Roman Catholic Church in the said diocese, so that the benefits arising therefrom shall accrue to the parish or district within which the lands to be sold, mortgaged, or leased shall be situate; but no person effecting an exchange shall be concerned to see to the vesting of any land exchanged by him, and no purchaser, mortgagee, or lessee shall be concerned to see to the application of the money paid by him or be responsible for the misapplication thereof.
