An Act to enable the New Plymouth Borough Council to effect an Exchange of Lands.
Preamble.
WHEREAS by the New Plymouth Recreation and Racecourse Reserve Act, 1887, the lands described in the First Schedule hereto (being a portion of the lands described in the Schedule to the said Act) were vested in the Mayor, Councillors, and Burgesses of the Borough of New Plymouth as a public reserve for the purposes set forth in section three thereof: And whereas the lands described in the Second Schedule hereto are now vested in Arthur Standish, of New Plymouth, solicitor, and William Litchfield Newman, of New Plymouth, accountant: And whereas the Mayor, Councillors, and Burgesses of the Borough of New Plymouth (hereinafter called the Corporation) are desirous of exchanging the lands described in the First Schedule for the lands described in the Second Schedule hereto:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the New Plymouth Recreation and Racecourse Reserve Exchange Act, 1909.
2 Land in First Schedule to be transferred.
The Corporation may transfer to the said Arthur Standish and William Litchfield Newman all the lands described in the First Schedule hereto; and upon the registration of such transfer the District Land Registrar at New Plymouth shall issue a certificate of title therefor in the names of the said Arthur Standish and William Litchfield Newman, and the said lands shall be deemed to be vested in them in all respects as the lands described in the Second Schedule hereto are now vested in them, and to be freed from the operation of the New Plymouth Recreation and Racecourse Reserve Act, 1887.
3 Land in Second Schedule to be transferred.
On such transfer being made, the said Arthur Standish and William Litchfield Newman shall transfer to the Corporation all the lands described in the Second Schedule hereto, and the said lands shall be held by the Corporation as if the same had been included in the Schedule to the New Plymouth Recreation and Racecourse Reserve Act, 1887, and be subject to all the provisions of that Act.
4 Rights of Taranaki Jockey Club in part of Racecourse Reserve to cease.
From and after the passing of this Act the Taranaki Jockey Club shall cease to have any rights whatever over the portion of the New Plymouth Racecourse and Recreation Reserve situated on the eastern side of Eliot Street, in the Town of New Plymouth.
SCHEDULES
FIRST SCHEDULE
All that parcel of land within the Borough of New Plymouth, being Sections Nos. 1267, 1268, 1269, 1270, 1271, 1272, 1273, and 1274, as shown on certificate of title, Vol. lv, folio 172, containing 2 acres and 23 perches. Bounded as follows: Commencing at a point on the southern boundary of Shortland Street; thence in a straight line running in a north-easterly direction on a bearing of 68° 43′ along said southern boundary of Shortland Street for a distance of 840·26 links to the intersection point of Shortland and Gover Streets; thence in a straight line running in a south-easterly direction on a bearing of 158° 43′ along the western boundary of Gover Street for a distance of 255·05 links to the point at which the New Plymouth Borough boundary-line intersects the western boundary of Gover Street; thence in a straight line running in a south-westerly direction on a bearing of 248° 43′ along the New Plymouth Borough boundary-line to a point for a distance of 840·05 links; thence in a straight line running in a north-westerly direction on a bearing of 338° 41′ for a distance of 255·05 links to the point of commencement.
SECOND SCHEDULE
All that parcel of land being Subdivision 1, part of New Plymouth Town Belt D, in the Fitzroy District, Block V, Paritutu Survey District, containing 2 acres and 23 perches. Bounded as follows: Commencing at the point at which the New Plymouth Borough boundary-line intersects the easterly boundary of Gover Street; thence in a straight line running in a north-easterly direction on a bearing of 68° 43′ to a point on said New Plymouth Borough boundary-line for a distance of 952·41 links; thence in a straight line running in a south-easterly direction on a bearing of 158°43′ to a point for a distance of 225·04 links; thence in a straight line running in a south-westerly direction on a bearing of 248° 43′ to a point for a distance of 952·41 links; thence in a straight line running in a north-westerly direction on a bearing of 338° 43′ for a distance of 225·04 links to the point of commencement.
