An Act to authorise the New Plymouth Harbour Board to reclaim certain Lands in the Harbour of New Plymouth and to vest the same in the said Board.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the New Plymouth Harbour Reclamation Act, 1909.
2 Special Act.
This Act shall be deemed to be a special Act within the meaning of the Harbours Act, 1908.
3 Interpretation.
In this Act “the Board”
means the New Plymouth Harbour Board as constituted under the Harbours Act, 1908.
4 Board may reclaim lands.
The Board may, subject to the provisions of the Harbours Act, 1908, from time to time fill up and reclaim from the sea the lands described in the First and Second Schedules to this Act, or any part thereof respectively; and may for that purpose, if it thinks fit, enter into any contract with any person for the execution of all or any works which may be necessary or expedient in or about the filling-up or reclamation of such lands as aforesaid, upon such terms and conditions as may seem to it proper and reasonable.
5 Lands in Schedule vested in Board as an endowment.
The lands described in the First and Second Schedules to this Act are hereby vested in the Board as an endowment for the Board for the purposes for which it is constituted, and subject to the provisions of the Harbours Act, 1908.
SCHEDULES
FIRST SCHEDULE
All that area of land, situated in Block IV, Paritutu Survey District, in the Land District of Taranaki, being portions of Reserves L and A now vested in the New Plymouth Harbour Board, and bounded as follows: Commencing at the point where the north-eastern boundary of the railway reserve meets the south-eastern side of the New Plymouth Breakwater; thence north-easterly along the said south-eastern side of the New Plymouth Breakwater a distance of 300 links; thence by a straight line drawn in a south-easterly direction at right angles to the New Plymouth Breakwater to the point where the said line first meets the low-water mark; thence generally following the low-water mark in a south-easterly direction to the point where the before-mentioned straight line drawn at right angles to the New Plymouth Breakwater again meets the low-water mark; thence generally southwesterly by a straight line drawn parallel to the New Plymouth Breakwater to high-water mark at a point distant 100 links easterly from the Hongihongi Stream; thence generally in a north-westerly direction along the north-east boundary of the New Plymouth-Moturoa Railway Reserve to the point of commencement.
SECOND SCHEDULE
All that piece of land below low-water mark, and adjacent to the land described in the First Schedule hereto, bounded as follows: Commencing at the point where the straight line drawn at right angles to the New Plymouth Breakwater first meets low-water mark, as described in the First Schedule hereto; thence in a southeasterly direction by the said straight line to the point where it again meets low-water mark; thence generally in a north-westerly direction along low-water mark to the point of commencement.
