An Act to authorise the Exchange of certain Lands between the Masterton Trust Lands Trustees and the Crown.
Preamble.
WHEREAS the lands described in the First Schedule hereto are vested for an estate in fee-simple in the Masterton Trust Lands Trustees (being a body corporate by virtue of the provisions of the Masterton Trust Lands Act, 1889): And whereas it is desirable to authorise and empower the said Trustees to transfer the said lands to the Crown in exchange for the land described in the Second Schedule hereto:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Masterton Trust Lands Exchange Act, 1909.
2 Power to Trustees to transfer certain lands to Crown.
The Masterton Trust Lands Trustees are hereby authorised and empowered to transfer to the Crown all their estate and interest in the lands described in the First Schedule hereto in exchange for the land described in the Second Schedule hereto, and by way of equality of exchange to pay out of any moneys in their hands the sum of one hundred pounds into the Public Account to the credit of the Consolidated Fund.
3 Governor may direct issue of title to Trustees for certain land.
Upon such transfer and payment by way of equality as aforesaid, and in consideration therefor, the Governor may, by warrant under his hand, direct the District Land Registrar to issue a certificate of title in favour of the said Trustees in respect of the land described in the Second Schedule hereto; and upon the registration of that certificate the land comprised therein shall vest in the said Trustees for an estate in fee-simple, and shall be subject to the same trusts as those to which the lands described in the First Schedule are now subject.

FIRST SCHEDULE
All that parcel of land in the Wellington Land District, containing by admeasurement 36·8 perches, more or less, being part of Section No. 2, Borough of Masterton: bounded towards the north-west by Chapel Street, 200 links; towards the northeast by Hall Street, 115 links; towards the south-east by the other part of the said Section No. 2, 200 links; and towards the south-west by Section No. 4, 115 links.
Also all that parcel of land in the Wellington Land District, containing by admeasurement 1 rood 27·2 perches, more or less, being part of Section No. 89, Borough of Masterton: bounded towards the north-west by Dixon Street, 227·3 links; towards the north-east by Park Avenue, 184·9 links; towards the south-east by Section No. 91, 227·3 links; and towards the south-west by the other part of Section No. 89, 184·9 links.
SECOND SCHEDULE
All that parcel of land in the Wellington Land District, containing by admeasurement 32·7 perches, more or less, being part of Section No. 2, Borough of Masterton: bounded towards the south-east by Queen Street, 81·81 links; towards the southwest by Section No. 4, 250 links; towards the north-west by the other part of the said Section No. 2, 81·81 links; and towards the north-east by other part of the said Section No. 2, 250 links.
