An Act to constitute the Waipara County.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Waipara County Act, 1909.
2 Constitution of Waipara County.
(1.)
The Waipara County is hereby constituted, and shall comprise that portion of the Ashley County particularly described in the First Schedule hereto.
(2.)
The boundaries of the Ashley County are hereby altered accordingly, and shall be those described in the Second Schedule hereto.
(3.)
The Counties Act, 1908, shall be in operation in the Waipara County.
3 Road district abolished.
The Waipara Road District is hereby abolished, and shall be deemed to be merged in the Waipara County constituted by this Act; and the provisions of section thirty-eight of the Counties Act, 1908, shall apply thereto accordingly.
4 Jurisdiction of County Council.
From and after the coming into operation of this Act no local body or authority other than the County Council shall, within the limits of the said county, exercise any jurisdiction or authority over any roads, or over or in relation to any matter or thing in respect of which jurisdiction is conferred upon County Councils under the provisions of any Act:
Provided that nothing herein shall affect the power of the Governor to proclaim any portion of the said county a borough or town district.
SCHEDULES
FIRST SCHEDULE Boundaries of Waipa Ra County
All that area in the Canterbury Land District the boundaries whereof are as follows: Commencing at Harper’s Pass, on the Hurunui River; thence easterly, following down the centre of that river, to the South Pacific Ocean; thence south-westerly along high-water mark to the mouth of the River Waipara; thence westerly and north-westerly by a line along the middle of the Waipara River and its South Branch to its source; thence by a straight line north-westerly to Block Hill, and again north-westerly from Block Hill to Ashley Head; thence northerly, following the top of the ranges, to Esk Head; and from thence westerly and north-westerly along the top of the Dampier Range and the Snowy Ranges to the summit of the Southern Alps; and from thence returning along the summit to Harper’s Pass, the commencing-point.
SECOND SCHEDULE Altered Boundaries of Ashley County
All that area in the Canterbury Land District bounded towards the north generally by the Waipara County as described in the First Schedule hereto, from the eastern boundary of Tawera County, as described in the First Schedule to the Tawera County Act, 1909, to the sea at the mouth of the Waipara River; thence towards the east by the sea to the mouth of the Waimakariri River; thence towards the south generally by the Waimairi and Selwyn Counties; and towards the west generally by the Tawera County aforesaid to the place of commencement: excepting the Boroughs of Kaiapoi and Rangiora.
