An Act to alter the Boundary between the Heathcote County and the Halswell County.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Heathcote County Boundary Act, 1911.
2 Severance of part of the County of Halswell.
That portion or area of the County of Halswell described in the First Schedule hereto shall cease to form part of the said County of Halswell, and shall be and is hereby transferred to and shall form part of the County of Heathcote.
3 Area of part transferred.
The said area described in the said First Schedule shall, subject to the powers of the Governor in Council and the Heathcote County Council to alter the same, be annexed to and be deemed part of the Cashmere Riding of the County of Heathcote, the boundaries whereof are described in the Second Schedule hereto.
4 Alteration of boundaries of County of Halswell.
The boundaries of the County of Heathcote are hereby altered as described in the Third Schedule hereto.
5 Alteration of boundaries of County of Heathcote.
The boundaries of the County of Halswell are hereby altered as described in the Fourth Schedule hereto.
6 Jurisdiction of Heathcote County Council to extend to part added.
From and after the coming into operation of this Act the Heathcote County Council shall exercise the same powers and jurisdiction over and relating to the said area described in the said First Schedule as if the said area had been included in the area described in the Third Schedule to the Selwyn County Subdivision Act, 1910, and all the jurisdiction and powers hitherto exercised by the Halswell County Council over the said area shall cease absolutely.
7 Provisions of existing Acts to apply.
The provisions of the Heathcote Road Board Waterworks Act, 1909, or any other local Acts now in force affecting the County of Heathcote or the Council thereof shall apply and be in force within the boundaries of the County of Heathcote as altered and as described in the said Third Schedule of this Act.
8 Counties Act, 1908, to apply.
The provisions of the Counties Act, 1908, relating to the alteration of boundaries between counties, and to the severance of part of one county, and the inclusion of such severed parts within the boundaries of another county, shall, on the coming into operation of this Act, notwithstanding that the alterations hereby effected are not carried out by agreement between the Heathcote County Council and the Halswell County Council, apply as between the County of Heathcote and the County of Halswell and their respective Councils.
SCHEDULES
FIRST SCHEDULE
All that area in the Canterbury Land District bounded towards the east generally by a line along the middle of Colombo Road South and Dyers’ Pass Road from the south boundary of the City of Christchurch to the summit of the Port Hills; towards the south-east by the summit of the Port Hills to the southernmost corner of Rural Section 452; thence towards the south-west and west by the road, known as Worsley’s Track, running along the north-east boundary of Rural Section 338, through Rural Sections 493 and 10210, along the south-west boundary of Rural Sections 31363, 31362, 2063, and the west and north-east boundaries of Rural Section 1325, and through Rural Section 383 to the north-east corner thereof, and by a right line to the middle of the Heathcote River; thence towards the north-west generally by the Borough of Spreydon to the place of commencement.
SECOND SCHEDULE Cashmere Riding of Heathcote County
All that area in Heathcote County bounded towards the north-east generally by the City of Christchurch from Colombo Road to St. Martin’s Riding as described in the New Zealand Gazette No. 22, of the 23rd March, 1911; thence by St. Martin’s Riding to the summit of the Port Hills; thence towards the south-east by the summit of the Port Hills to the southernmost corner of Rural Section 452; thence towards the south-west and west by the road, known as Worsley’s Track, running along the north-east boundary of Rural Section 338, through Rural Sections 493 and 10210, along the south-west boundaries of Rural Sections 31363, 31362, 2063, and the west and north-east boundaries of Rural Section 1325, and through Rural Section 383 to the north-east corner thereof, and by a right line to the middle of the Heathcote River; thence towards the north-west and north generally by the Borough of Spreydon as described in the Seventh Schedule to the Selwyn County Subdivision Act, 1910, to the place of commencement.
THIRD SCHEDULE Heathcote County
All that area in the Canterbury Land District bounded towards the north generally by Waimairi County as described in the First Schedule to the Waimairi County Act, 1909, from the City of Christchurch to the Borough of New Brighton; thence towards the east generally by the Borough of New Brighton to the estuary of the Heathcote and Avon Rivers; thence towards the south-east by the said estuary to the north-eastern boundary of the Borough of Woolston; and thence towards the south-west generally by the Borough of Woolston and the City of Christchurch to the place of commencement.
Also all that area in the Canterbury Land District bounded towards the east by the Borough of Sumner from the estuary of the Heathcote and Avon Rivers to the Borough of Lyttelton; thence towards the south generally by the Borough of Lyttelton to its north-western corner; thence by the summit of the Port Hills to the southernmost corner of Rural Section 452; thence towards the south-west and west by the road, known as Worsley’s Track, running along the north-east boundary of Rural Section 338, through Rural Sections 493 and 10210, along the south-west boundaries of Rural Sections 31363, 31362, 2063, and the west and north-east boundaries of Rural Section 1325, and through Rural Section 383 to the north-east corner thereof, and by a right line to the middle of the Heathcote River; thence towards the north-west and north generally by the Borough of Spreydon, the City of Christchurch, and the Borough of Woolston to the estuary of the Heathcote and Avon Rivers; and thence by the said estuary to the place of commencement.
FOURTH SCHEDULE Halswell County
All that area in the Canterbury Land District bounded towards the north-east by Waimairi County as described in the First Schedule of the Waimairi County Act, 1909, from Middle Lincoln Road to the Heathcote River; thence towards the northeast generally by a line along the middle of that river to a point opposite the northeast corner of Rural Section 383; thence by Heathcote County as described in the Third Schedule hereto to the summit of the Port Hills; thence towards the southeast generally by the Mount Herbert County and Wairewa County to the Halswell River; thence towards the south-west generally by a line along the middle of that river to Paparua County as described in the Second Schedule to the Selwyn County Subdivision Act, 1910; and thence towards the west generally by the said Paparua County to the place of commencement.
