An Act to amend the Christchurch District Drainage Act, 1907.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

This Act may be cited as the Christchurch District Drainage Amendment Act, 1911, and shall form part of and be read together with the Christchurch District Drainage Act, 1907 (hereinafter referred to as the principal Act).

2 Liability of certain local authorities to contribute to certain works.

(1.)

The local authorities mentioned in the first column of the First Schedule hereto shall be liable, and shall as from the first day of April, nineteen hundred and eleven, be deemed to have been liable, to contribute towards the cost from time to time incurred by the Board in cleaning the Heathcote River.

(2.)

The proportions in which such contributions shall be made shall be those set against the name of each such local authority in the third column of the said First Schedule.

3 Liability of Waimairi County Council to contribute to certain works.

(1.)

The Waimairi County Council shall in like manner contribute towards the cost from time to time incurred by the Board in cleaning the streams and drains marked 25, 26, 27, 28, and 35 on the drainage-plan deposited in the office of the Board.

(2.)

The proportion in which such contribution shall be made shall be that mentioned in the third column of the Second Schedule hereto.

4 Engineer’s certificate of cost to be final.

A certificate under the hand of the Engineer of the Board shall be conclusive proof of the amount expended by the Board during the period to which the certificate relates in the cleaning of the Heathcote River and in the cleaning of the streams and drains referred to in section three hereof.

5 Payments, how to be provided for.

The amount from time to time payable by any local authority under this Act may be paid out of its ordinary funds; and in order to meet any such payment the local authority may, in addition to its other rating-powers, by special order make and levy a separate rate on all rateable property within the area set opposite the name of that local authority and described in the second column of the First or Second Schedule hereto, as the case may be.

W; thence generally southerly along the watershed of the hill to the northern boundary of Reserve 101; thence generally south-westerly along the summit of the Port Hills (being the southern boundary of the Heathcote County) to Dyer’s Pass Road; thence generally northerly along Dyer’s Pass and Colombo Roads (being the western boundary of the Heathcote County) to the Heathcote River; thence generally easterly along the Heathcote River to its intersection with the north-eastern side of the Christchurch-Lyttelton Railway; thence generally south-easterly along the north-eastern boundary of that railway to the eastern boundary of Rural Section 245; thence northerly along that boundary to the Heathcote River; thence generally easterly, following the Heathcote River, to a point in line with the northern boundary of Rural Section 1161; and thence by a straight line to the commencing-point	15 per centum on the area transferred to the Heathcote County by the Heathcote County Boundary Act, 1911, and 25 per centum on the remainder of the Heathcote County.
Halswell County Council	All that area commencing at the southernmost corner of Rural Section 180; thence north-easterly along the south-east boundary of that section to the westernmost corner of Rural Section 488; thence south -easterly along Lincoln and Riccarton Junction Roads to the southernmost corner of Rural Section 159; thence generally south-easterly and north-easterly along the Heathcote River to Colombo Road; thence generally southerly, south-westerly, south-easterly, and again south-westerly along the eastern boundary of the Halswell County to the southern side of the road intersecting Rural Section 520; thence westerly along the southern side of the said road to the south-western boundary of Rural Section 520; thence generally north-westerly along the northern boundary of Rural Sections 521 and 33742 to the westernmost corner of the last-mentioned section; thence generally north-westerly along the north-eastern boundary of Rural Sections 30503. 17736. 17494, 30249, 33747, 6358, and 486 to the northernmost corner of the last-mentioned section; thence generally south -westerly along the north-western boundary of Rural Sections 486 and 6357 to the westernmost corner of the last-mentioned section; thence westerly along the northernmost boundary of Rural Section 1108 and a line in continuation thereof to the western side of Quarry Road; thence generally northerly along the western side of that road and Lower Lincoln Road to the easternmost corner of Rural Section 225; thence north-westerly along the south-western side of Dunbar’s and Eaglesom’s Roads and a line m continuation thereof to the centre of Middle Lincoln Road; thence north-easterly along the centre of that road to a point in line with the south-western side of Rural Section 180; and thence north-westerly to the commencing-point	15 per centuni.
Woolston Borough Council	All that area commencing at the intersection of the eastern boundary of Rural Section 245 with the north-eastern boundary of the Christchurch-Lyttelton Railway; thence north-westerly along the north-eastern boundary of the said railway to the southernmost corner of Rural Section 96; thence generally north-easterly, south-easterly, westerly, south-easterly, and easterly along the Heathcote River to a point in line with the eastern boundary of Rural Section 245; and thence along the eastern boundary of that section to the commencing-point	10 per centum.

SECOND SCHEDULE

Name of Local Authority.	Rating-area.	Proportion of Cost to be contributed.
	All that area commencing at the intersection of the centre of Riccarton Road with the eastern side of Webb’s Road; thence south-westerly crossing Webb’s Road and along the centre of Riccarton Road to its junction with the centre of Yaldhurst Road; thence north-westerly along the centre of that road to a point in line with the boundary between Rural Sections 177 and 177a; thence north-easterly along that boundary to the south -western boundary of Rural Section 178c; thence south-easterly along the south-western boundary of that section to the western side of Avonhead Road; thence northerly along the western side of that road and a line in continuation thereof to the south-western boundary of Rural Section 117; thence south-easterly along the south-western boundary of that section to the Waimairi Stream; thence along that stream to Webb’s Road; and thence south-easterly along the said road to the commencing-point	10 per centum.
