An Act to amend the Christchurch District Drainage Act, 1907.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Christchurch District Drainage Amendment Act, 1911, and shall form part of and be read together with the Christchurch District Drainage Act, 1907 (hereinafter referred to as the principal Act).
2 Liability of certain local authorities to contribute to certain works.
(1.)
The local authorities mentioned in the first column of the First Schedule hereto shall be liable, and shall as from the first day of April, nineteen hundred and eleven, be deemed to have been liable, to contribute towards the cost from time to time incurred by the Board in cleaning the Heathcote River.
(2.)
The proportions in which such contributions shall be made shall be those set against the name of each such local authority in the third column of the said First Schedule.
3 Liability of Waimairi County Council to contribute to certain works.
(1.)
The Waimairi County Council shall in like manner contribute towards the cost from time to time incurred by the Board in cleaning the streams and drains marked 25, 26, 27, 28, and 35 on the drainage-plan deposited in the office of the Board.
(2.)
The proportion in which such contribution shall be made shall be that mentioned in the third column of the Second Schedule hereto.
4 Engineer’s certificate of cost to be final.
A certificate under the hand of the Engineer of the Board shall be conclusive proof of the amount expended by the Board during the period to which the certificate relates in the cleaning of the Heathcote River and in the cleaning of the streams and drains referred to in section three hereof.
5 Payments, how to be provided for.
The amount from time to time payable by any local authority under this Act may be paid out of its ordinary funds; and in order to meet any such payment the local authority may, in addition to its other rating-powers, by special order make and levy a separate rate on all rateable property within the area set opposite the name of that local authority and described in the second column of the First or Second Schedule hereto, as the case may be.
